A bill for an act
relating to public safety; expanding a grant program to facilitate access to local
programs to address technical violations by nonviolent controlled substance
offenders; requiring a report; appropriating money; amending Laws 2017, chapter
95, article 3, section 30.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2017, chapter 95, article 3, section 30, is amended to read:

Sec. 30. ALTERNATIVES TO INCARCERATION PILOT PROGRAM deleted text begin FUND deleted text end .

(a) Agencies providing supervision to offenders on probation, parole, or supervised
release are eligible for grants to facilitate access to community options including, but not
limited to, inpatient chemical dependency treatment for nonviolent controlled substance
offenders to address and correct behavior that is, or is likely to result in, a technical violation
of the conditions of release. For purposes of this section, "nonviolent controlled substance
offender" is a person who meets the criteria described under Minnesota Statutes, section
244.0513, subdivision 2, clauses (1), (2), and (5), and "technical violation" means a violation
of a court order of probation, condition of parole, or condition of supervised release, except
an allegation of a subsequent criminal act that is alleged in a formal complaint, citation, or
petition.

(b) The Department of Corrections shall deleted text begin establish criteria for selecting grant recipients
and the amount awarded to each grant recipient deleted text end new text begin issue annual grants of $160,000 to each
grant recipient new text end .

report to the chairs of the house of representatives and senate committees with jurisdiction
over public safety policy and finance new text begin by January 15 of each year new text end . At a minimum, the report
must include:

deleted text begin (1) the total number of grants issued under this program;

deleted text begin (2) the average amount of each grant;
deleted text end

deleted text begin (3) deleted text end new text begin (1) new text end the community services accessed as a result of the grants;

deleted text begin (4) deleted text end new text begin (2) new text end a summary of the type of supervision offenders were under when a grant was
used to help access a community option;

deleted text begin (5) deleted text end new text begin (3) new text end the number of individuals who completed, and the number who failed to complete,
programs accessed as a result of this grant; deleted text begin and

deleted text begin (6) deleted text end new text begin (4) new text end the number of individuals who violated the terms of release following participation
in a program accessed as a result of this grant, separating technical violations and new
criminal offenses deleted text begin . deleted text end new text begin ;

new text begin (5) the number of individuals who completed or were discharged from probation after
participating in the program;

new text begin (6) the number of individuals identified in clause (5) who committed a new offense after
discharge from the program;

new text begin (7) identification of barriers nonviolent controlled substance offenders face in accessing
community services and a description of how the program navigates those barriers; and

new text begin (8) identification of gaps in existing community services for nonviolent controlled
substance offenders.

Sec. 2. new text begin ALTERNATIVES TO INCARCERATION PILOT PROGRAM GRANT;
APPROPRIATION.

new text begin $160,000 in fiscal year 2020 and $160,000 in fiscal year 2021 are appropriated from the
general fund to the commissioner of corrections for a grant to Wright County to facilitate
access to community treatment options under the alternatives to incarceration program.
