1.2relating to disaster relief; appropriating money for lake cleanup in LeSueur
1.3County; proposing coding for new law in Minnesota Statutes, chapter 103G.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [103G.122] COMMISSIONER'S AUTHORITY TO REMOVE
1.6DEBRIS.
1.7    (a) The commissioner shall remove debris from public waters that was:
1.8    (1) caused by a disaster or a public emergency as defined in chapter 12; and
1.9    (2) constitutes a threat to public safety in any way, including swimming, boating, or
1.10other recreational use of the public waters.
1.11    (b) A statutory or home rule charter city or county may allow residents and adjacent
1.12property owners to place debris retrieved from public waters onto the public access for
1.13pickup.

1.14    Sec. 2. PUBLIC WATERS DEBRIS CLEARANCE FUND.
1.15    Subdivision 1. Fund created. A public waters debris clearance fund is created to
1.16assure that public waters are cleaned and maintained from debris that is deposited into the
1.17public waters by disasters, as defined in Minnesota Statutes, chapter 12.
1.18    If the governor has declared a state of emergency, money in this fund shall be
1.19appropriated to the commissioner of natural resources for the removal of debris, which
1.20were deposited by a disaster, from public waters. The commissioner of natural resources
1.21may contract or provide grants to local governments to accomplish these purposes.
1.22    If a federal disaster is declared, the reimbursement for debris removal from public
1.23waters must be deposited into the public waters debris clearance fund.
2.1    Subd. 2. Appropriation. $2,000,000 is appropriated from the general fund for fiscal
2.2year 2008 to the commissioner of natural resources, for deposit into the public waters
2.3debris clearance fund. This is a onetime appropriation that is available until expended.

2.4    Sec. 3. APPROPRIATION; TORNADO RELIEF.
2.5    $79,000 is appropriated from the general fund for fiscal year 2007 to the
2.6commissioner of employment and economic development for a grant to Le Sueur County
2.7for the cost of cleaning debris from lakes in Le Sueur County, caused by the August
2.824, 2006, tornado in southern Le Sueur County. This appropriation is available until
2.9June 30, 2008.
2.10EFFECTIVE DATE.This section is effective the day following final enactment.
