  1.1                          A bill for an act 
  1.2             relating to game and fish; exempting certain dark 
  1.3             houses and fish houses from the licensing requirement; 
  1.4             amending Minnesota Statutes 1998, section 97C.355, 
  1.5             subdivisions 1 and 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 97C.355, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [IDENTIFICATION REQUIRED.] All shelters 
  1.10  required to be licensed on the ice of state waters, including 
  1.11  dark houses and fish houses, must have the name and address or 
  1.12  driver's license number of an owner legibly painted on the 
  1.13  exterior with characters at least three inches high. 
  1.14     Sec. 2.  Minnesota Statutes 1998, section 97C.355, 
  1.15  subdivision 2, is amended to read: 
  1.16     Subd. 2.  [LICENSE REQUIRED.] A person may not take fish 
  1.17  from a dark house or fish house unless the house is licensed and 
  1.18  has a durable license tag attached to the exterior as prescribed 
  1.19  by the commissioner, except as provided in this subdivision.  
  1.20  The commissioner must issue a durable tag that is at least two 
  1.21  inches in diameter with a 3/16 inch hole in the center with a 
  1.22  dark house or fish house license.  The durable tag must be 
  1.23  marked with a number to correspond with the license and the year 
  1.24  of issue.  A dark house or fish house license is not required of 
  1.25  a resident: 
  2.1      (1) on boundary waters where the adjacent state does not 
  2.2   charge a fee for the same activity; or 
  2.3      (2) anywhere in the state when the dark house or fish house 
  2.4   is occupied and not left on the ice for over 24 consecutive 
  2.5   hours.
