  1.1                          A bill for an act 
  1.2             relating to state government; establishing the 
  1.3             intergovernmental advisory council for technology; 
  1.4             abolishing the intergovernmental information systems 
  1.5             advisory council; transferring appropriated money; 
  1.6             appropriating money; amending Minnesota Statutes 1998, 
  1.7             section 16B.42, subdivision 4, and by adding 
  1.8             subdivisions; repealing Minnesota Statutes 1998, 
  1.9             section 16B.42, subdivisions 1, 2, and 3. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1998, section 16B.42, is 
  1.12  amended by adding a subdivision to read: 
  1.13     Subd. 3a.  [COMPOSITION.] The intergovernmental advisory 
  1.14  council on technology consists of: 
  1.15     (1) four county members appointed by the association of 
  1.16  Minnesota counties; 
  1.17     (2) one first class city member and three members from 
  1.18  second or third class cities appointed by the League of 
  1.19  Minnesota Cities; 
  1.20     (3) two members of cities of the fourth class appointed by 
  1.21  the association of small cities; 
  1.22     (4) two members from K-12 school districts appointed by the 
  1.23  Minnesota association of school administrators; 
  1.24     (5) one township member appointed by the Minnesota 
  1.25  Association of Townships; 
  1.26     (6) one public librarian appointed by the commissioner of 
  1.27  children, families, and learning in consultation with the office 
  2.1   of library development and services; 
  2.2      (7) one member from the metropolitan council appointed by 
  2.3   the council; 
  2.4      (8) one member from a regional development commission 
  2.5   appointed jointly by the Minnesota regional development 
  2.6   commissions; 
  2.7      (9) one member each from the departments of administration; 
  2.8   children, families, and learning; economic security; human 
  2.9   services; and revenue, appointed by the respective 
  2.10  commissioners; 
  2.11     (10) one member each from the office of strategic and 
  2.12  long-range planning and the office of technology, appointed by 
  2.13  the respective agency head; 
  2.14     (11) one member from the office of the state auditor 
  2.15  appointed by the state auditor; 
  2.16     (12) one member each representing the league of Minnesota 
  2.17  cities, the association of Minnesota counties, the Minnesota 
  2.18  association of townships, and the Minnesota association of 
  2.19  school administrators, appointed by each respective 
  2.20  organization; and 
  2.21     (13) one representative of Native American Indians, 
  2.22  appointed by the Indian affairs council. 
  2.23     The terms, compensation, and removal of council members and 
  2.24  the filling of membership vacancies are governed by section 
  2.25  15.059. 
  2.26     Sec. 2.  Minnesota Statutes 1998, section 16B.42, is 
  2.27  amended by adding a subdivision to read: 
  2.28     Subd. 3b.  [DUTIES.] The council shall: 
  2.29     (1) collaborate with the office of technology, the 
  2.30  department of administration, other state agencies, local 
  2.31  governments, and the legislature on intergovernmental technology 
  2.32  initiatives, issues, and programs; 
  2.33     (2) act as a liaison among state and local governments and 
  2.34  organizations representing groups of governmental units to 
  2.35  communicate about technology issues and concerns; 
  2.36     (3) facilitate and recommend the adoption of best practices 
  3.1   of information systems and related technology to state and local 
  3.2   governments; 
  3.3      (4) provide technology-related education and training 
  3.4   opportunities; 
  3.5      (5) provide grants to demonstrate and transfer useful 
  3.6   advances in information systems and related technologies to 
  3.7   state and local governments; and 
  3.8      (6) represent local governments on the information policy 
  3.9   council and provide linkages to other related councils, boards, 
  3.10  and commissions. 
  3.11     Sec. 3.  Minnesota Statutes 1998, section 16B.42, is 
  3.12  amended by adding a subdivision to read: 
  3.13     Subd. 3c.  [OTHER DUTIES.] The council shall elect an 
  3.14  executive committee, not to exceed seven members from its 
  3.15  membership, to provide guidance and oversight to staff and 
  3.16  project operations.  The executive committee shall select an 
  3.17  executive director to serve in the classified service.  The 
  3.18  council may appoint committees and task forces, which may 
  3.19  include persons other than council members, to assist the 
  3.20  council in carrying out its duties.  The executive committee 
  3.21  shall appoint council members to implement the duties of the 
  3.22  council.  The council shall develop a biennial plan to provide a 
  3.23  focus for operations in coordination with legislative issues and 
  3.24  needs of constituents of the council.  Each member of the 
  3.25  council shall solicit input from, and report back to, the 
  3.26  organization, agency, or governmental unit the member represents.
  3.27     Sec. 4.  Minnesota Statutes 1998, section 16B.42, 
  3.28  subdivision 4, is amended to read: 
  3.29     Subd. 4.  [FUNDING.] Appropriations and other funds made 
  3.30  available to the council for staff, operational expenses, 
  3.31  projects, and grants are under the control of the council.  The 
  3.32  council may contract with shall prepare its budget, to be 
  3.33  administered through the department of administration for staff 
  3.34  services and administrative support.  The council shall 
  3.35  reimburse the department for these services.  The department of 
  3.36  administration shall provide other appropriate administrative 
  4.1   support to the council.  The council may request assistance from 
  4.2   other state and local agencies in carrying out its duties.  Fees 
  4.3   charged to local units of government for the administrative 
  4.4   costs of the council and revenues derived from royalties, 
  4.5   reimbursements, or other fees from software programs, systems, 
  4.6   or technical services arising out of activities funded by 
  4.7   current or prior state appropriations must be credited to the 
  4.8   general fund.  The unencumbered balance of an appropriation in 
  4.9   the first year of a biennium does not cancel but is available 
  4.10  for the second year of the biennium. 
  4.11     Sec. 5.  [TRANSFER OF APPROPRIATION.] 
  4.12     Unexpended money appropriated to the intergovernmental 
  4.13  information systems advisory council is transferred to the 
  4.14  intergovernmental advisory council for technology. 
  4.15     Sec. 6.  [APPROPRIATION.] 
  4.16     $....... is appropriated to the intergovernmental advisory 
  4.17  council for technology for the fiscal years beginning July 1, 
  4.18  1999, and July 1, 2000. 
  4.19     Sec. 7.  [REPEALER.] 
  4.20     Minnesota Statutes 1998, section 16B.42, subdivisions 1, 2, 
  4.21  and 3, are repealed.
