  1.1                          A bill for an act 
  1.2             relating to public health; requiring the immunization 
  1.3             of students attending the Minnesota state colleges and 
  1.4             universities against hepatitis B; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 136F. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [136F.205] [STUDENT IMMUNIZATION AGAINST 
  1.8   HEPATITIS B.] 
  1.9      Subdivision 1.  [REQUIREMENT.] Except as provided in 
  1.10  subdivision 2, no person shall be allowed to enroll or remain 
  1.11  enrolled in a campus of the state colleges and universities 
  1.12  until that person has submitted, pursuant to policy adopted by 
  1.13  the board, a statement from a physician or a public clinic that 
  1.14  provides immunizations stating that the person has received an 
  1.15  immunization against hepatitis B. 
  1.16     Subd. 2.  [EXEMPTIONS FROM IMMUNIZATIONS.] (a) If a 
  1.17  statement, signed by a physician, is submitted stating that an 
  1.18  immunization is contraindicated for medical reasons or that 
  1.19  laboratory confirmation of the presence of adequate immunity 
  1.20  exists, the immunization statement specified in subdivision 1 
  1.21  need not be required. 
  1.22     (b) If a notarized statement signed by the enrollee is 
  1.23  submitted stating that the person has not been immunized because 
  1.24  of conscientiously held beliefs, the immunization statement 
  1.25  specified in subdivision 1 shall not be required. 
  2.1      Subd. 3.  [FILE ON IMMUNIZATION RECORDS.] Each campus shall 
  2.2   maintain on file immunization records for all persons in 
  2.3   attendance that contains the information required by this 
  2.4   section for at least five years.  The department of health shall 
  2.5   have access to the files maintained pursuant to this section.  
  2.6   When a person transfers to another campus in the system, the 
  2.7   immunization file shall be transferred to the new campus within 
  2.8   30 days of the transfer. 
  2.9      Sec. 2.  [EFFECTIVE DATE.] 
  2.10     Section 1 is effective January 1, 2000.
