  1.1                          A bill for an act 
  1.2             relating to education; expanding the first-grade 
  1.3             preparedness programs to designate revenue for 
  1.4             qualified property poor school districts; 
  1.5             appropriating money; amending Minnesota Statutes 2000, 
  1.6             section 124D.081, subdivisions 2, 6, and by adding a 
  1.7             subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 124D.081, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [QUALIFYING DISTRICT.] A school district may 
  1.12  receive first-grade preparedness revenue for qualifying school 
  1.13  sites if, consistent with subdivision 5, the school board 
  1.14  approves a resolution requiring the district to provide services 
  1.15  to all children located in a qualifying school site attendance 
  1.16  area under subdivision 3 or qualifying district under 
  1.17  subdivision 3a. 
  1.18     Sec. 2.  Minnesota Statutes 2000, section 124D.081, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 3a.  [QUALIFYING SCHOOL DISTRICTS.] The commissioner 
  1.21  shall also rank all school districts with kindergarten programs 
  1.22  that do not exclusively serve students under sections 125A.03 to 
  1.23  125A.24, and 125A.65, on the basis of property wealth.  The 
  1.24  ranking must be from lowest to highest based on the district's 
  1.25  1999 adjusted net tax capacity per fiscal year 1999 adjusted 
  1.26  pupil units.  To qualify for this revenue, a school district 
  2.1   must have a 1999 adjusted net tax capacity per fiscal year 1999 
  2.2   adjusted pupil unit of less than $2,500.  A school district must 
  2.3   also have had an all-day everyday kindergarten program in place 
  2.4   during fiscal year 2000 and fiscal year 2001, and have 
  2.5   experienced a decline in district adjusted pupil units from 
  2.6   fiscal year 1999 to fiscal year 2001. 
  2.7      Once a school district is calculated to be eligible, it 
  2.8   remains eligible. 
  2.9      Sec. 3.  Minnesota Statutes 2000, section 124D.081, 
  2.10  subdivision 6, is amended to read: 
  2.11     Subd. 6.  [PREPAREDNESS REVENUE.] (a) A qualifying school 
  2.12  district is eligible for first-grade preparedness revenue equal 
  2.13  to the basic formula allowance for that year times the number of 
  2.14  children five years of age or older enrolled in a kindergarten 
  2.15  program at the site on October 1 of the previous year times 
  2.16  .53 for qualifying sites under subdivision 3 or .557 for 
  2.17  qualifying school districts under subdivision 3a. 
  2.18     (b) This revenue must supplement and not replace 
  2.19  compensatory revenue that the district uses for the same or 
  2.20  similar purposes under chapters 120B, 123A, 123B, 124D, 126C, 
  2.21  and 127A. 
  2.22     (c) A pupil enrolled in the first grade first-grade 
  2.23  preparedness program at a qualifying school site under 
  2.24  subdivision 3 or qualifying district under subdivision 3a is 
  2.25  eligible for transportation under section 123B.88, subdivision 1.
  2.26     (d) First grade First-grade preparedness revenue paid to a 
  2.27  charter school for which a school district is providing 
  2.28  transportation according to section 124D.10, subdivision 16, 
  2.29  shall be decreased by an amount equal to the product of the 
  2.30  formula allowance according to section 126C.10, subdivision 2, 
  2.31  times .0485 times the pupil units calculated according to 
  2.32  paragraph (a).  This amount shall be paid to the school district 
  2.33  for transportation costs. 
  2.34     Sec. 4.  [APPROPRIATION.] 
  2.35     (a) The sums indicated in this section are appropriated for 
  2.36  the fiscal years designated from the general fund to the 
  3.1   commissioner of children, families, and learning for grants for 
  3.2   the first-grade preparedness program under Minnesota Statutes, 
  3.3   section 124D.081:

  3.6      (b) Of these amounts, $....... each year must first be used 
  3.7   to fund programs operating in qualified property poor school 
  3.8   districts under Minnesota Statutes, section 124D.081, 
  3.9   subdivision 3a. 
  3.10     (c) Of these amounts, $....... each year must first be used 
  3.11  to fund programs operating during the 2000-2001 school year, 
  3.12  unless the site's ranking, as determined by Minnesota Statutes, 
  3.13  section 124D.081, subdivision 3, falls below the state average 
  3.14  for elementary schools. 
  3.15     (d) Any remaining amounts after funding programs under 
  3.16  paragraph (b) and (c) may be used to expand the number of sites 
  3.17  according to Minnesota Statutes, section 124D.081, subdivision 
  3.18  3, or districts under Minnesota Statutes, section 124D.081, 
  3.19  subdivision 3a.
