  1.1                          A bill for an act 
  1.2             relating to assessors; prescribing the additional 
  1.3             offices that a county or city assessor may hold; 
  1.4             eliminating obsolete record keeping and affidavit 
  1.5             requirements; amending Minnesota Statutes 2002, 
  1.6             section 273.061, by adding subdivisions; repealing 
  1.7             Minnesota Statutes 2002, section 274.04. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 273.061, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 1a.  [COMPATIBLE OFFICES.] A person appointed as the 
  1.12  county assessor also may serve as the county auditor, county 
  1.13  treasurer, or county auditor-treasurer if those offices are 
  1.14  appointive, provided that the person in the combined appointed 
  1.15  office must not serve on the county board of appeal and 
  1.16  equalization under section 274.13.  In a county in which the 
  1.17  functions of the county assessor are combined with those of the 
  1.18  county auditor or auditor-treasurer, the county board must 
  1.19  assign a county employee or official other than the 
  1.20  auditor-assessor to approve the applications as provided in 
  1.21  section 375.192, subdivision 2. 
  1.22     Sec. 2.  Minnesota Statutes 2002, section 273.061, is 
  1.23  amended by adding a subdivision to read 
  1.24     Subd. 1b.  [COMPATIBLE OFFICES IN COUNTIES CHANGING TO 
  1.25  APPOINTED AUDITOR.] In a county in which the office of auditor, 
  1.26  treasurer, or auditor-treasurer is an elective position, a 
  2.1   person appointed as the county assessor also may serve as the 
  2.2   county auditor, county treasurer, or county auditor-treasurer if 
  2.3   a proposal to make the affected office appointive has been 
  2.4   approved and will be effective within five years. 
  2.5      Sec. 3.  Minnesota Statutes 2002, section 273.061, is 
  2.6   amended by adding a subdivision to read 
  2.7      Subd. 1c.  [INCOMPATIBLE OFFICES.] The person appointed as 
  2.8   the county assessor must not also be the county attorney, a 
  2.9   county board member, or a city council member for a city in the 
  2.10  same county.  The person appointed as the city assessor must not 
  2.11  also be a city council member for the same city.  An assessor 
  2.12  who accepts a position that is incompatible with the office of 
  2.13  assessor is deemed to have resigned from the assessor position 
  2.14  on January 2, 2004, or on the day the person takes the oath of 
  2.15  office for the other office, whichever is later. 
  2.16     Sec. 4.  [REPEALER.] 
  2.17     Minnesota Statutes 2002, section 274.04, is repealed. 
  2.18     Sec. 5.  [EFFECTIVE DATE.] 
  2.19     This act is effective January 2, 2004.
