  1.1                          A bill for an act 
  1.2             relating to government data practices; authorizing 
  1.3             counties to give property owners the option of 
  1.4             excluding their names from lists released for 
  1.5             nongovernment purposes; proposing coding for new law 
  1.6             in Minnesota Statutes, chapter 13. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [13.496] [PROPERTY TAX DATA; OPTION TO WITHHOLD 
  1.9   ACCESS FOR NONGOVERNMENT PURPOSES.] 
  1.10     Subdivision 1.  [APPLICATION.] This section applies to a 
  1.11  county if the county board has approved application of the 
  1.12  section to the county.  
  1.13     Subd. 2.  [PROCEDURE.] A county shall send an owner of 
  1.14  property in the county that is subject to property taxation a 
  1.15  clear and conspicuous notice that the owner's name and other 
  1.16  information may be disclosed for nongovernment purposes, 
  1.17  including surveys, marketing, and solicitation.  The notice must 
  1.18  be in a form that includes a provision under which the owner may 
  1.19  request that the owner's name be excluded from lists generated 
  1.20  by the county and disclosed to a nongovernment entity.  If the 
  1.21  property owner so requests on the form provided, the county 
  1.22  shall exclude the owner's name from any list generated by the 
  1.23  county and disclosed to a nongovernment entity.
