A bill for an act
relating to transportation; appropriating money for highway and bridge
construction projects.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin APPROPRIATION; HIGHWAY AND BRIDGE CONSTRUCTION.

new text begin (a) $750,000,000 is appropriated for the fiscal biennium ending June 30, 2009, from
the general fund to the commissioner of transportation for construction, reconstruction,
and improvement of highway systems, including design-build contracts and consultant
usage to support these activities. This includes the cost of actual payments to landowners
for lands acquired for highway rights-of-way, payments to lessees, interest subsidies, and
relocation expenses. Of this appropriation, the commissioner of transportation may use
up to $127,500,000 for program delivery. Of this appropriation, $375,000,000 is added
to the transportation appropriation base beginning in fiscal year 2010 for distribution
under paragraphs (b) and (c). Notwithstanding Minnesota Statutes, section 16A.28, this
appropriation is available until expended.

new text begin (b) Ninety-five percent of the money appropriated under this section must be used in
the same manner as money from the highway user tax distribution fund and distributed
as follows:

new text begin (1) 62 percent to the trunk highway fund;
new text end

new text begin (2) 29 percent to the county state-aid highway fund; and
new text end

new text begin (3) nine percent to the municipal state-aid street fund.

new text begin (c) The remaining five percent of the money appropriated under this section must
be used in the same manner as the five percent of the highway user tax distribution fund
apportioned under Minnesota Statutes, section 161.081, deposited in the county state-aid
highway fund, and distributed as follows:

new text begin (1) 30.5 percent to the town road account under Minnesota Statutes, section 162.081;

new text begin (2) 16 percent to the town bridge account under Minnesota Statutes, section 161.082,
subdivision 2a; and

new text begin (3) 53.5 percent to the flexible highway account under Minnesota Statutes, section
161.081, subdivision 3.
