  1.1                          A bill for an act 
  1.2             relating to transportation; establishing multimodal 
  1.3             transportation fund for highway and transit projects; 
  1.4             proposing constitutional amendment to dedicate 
  1.5             revenues from motor vehicle sales tax to multimodal 
  1.6             transportation fund; amending Minnesota Statutes 2000, 
  1.7             section 297B.09, subdivision 1; proposing coding for 
  1.8             new law in Minnesota Statutes, chapter 174.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [174.91] [MULTIMODAL TRANSPORTATION FUND.] 
  1.11     Subdivision 1.  [FUND ESTABLISHED.] A multimodal 
  1.12  transportation fund is created in the state treasury.  The fund 
  1.13  consists of money credited under section 297B.09, subdivision 1, 
  1.14  and other money credited to the fund by law. 
  1.15     Subd. 2.  [ALLOCATION OF REVENUE.] Of the money in the 
  1.16  multimodal transportation fund: 
  1.17     (1) On the tenth day of each month, 32 percent must be 
  1.18  transferred to the highway user tax distribution fund. 
  1.19     (2) Remaining money in the fund is appropriated to the 
  1.20  commissioner for expenditure as provided in subdivision 3. 
  1.21     Subd. 3.  [USE AS FEDERAL MATCHING MONEY.] (a) Of amounts 
  1.22  appropriated to the commissioner under subdivision 2, 62 percent 
  1.23  must be spent by the commissioner to match available federal 
  1.24  funds for transportation projects undertaken by the commissioner 
  1.25  and included in the commissioner's statewide transportation 
  1.26  improvement program. 
  1.27     (b) The remaining 38 percent must be spent by the 
  2.1   commissioner as grants to political subdivisions for the 
  2.2   following purposes: 
  2.3      (1) to match available federal funds for transportation 
  2.4   projects undertaken by those political subdivisions requiring 
  2.5   such a match, where the expenditure has been approved by an area 
  2.6   transportation partnership for the geographic area in which the 
  2.7   project is located and is included in the commissioner's 
  2.8   statewide transportation improvement program; and 
  2.9      (2) other highway and public transit purposes, including 
  2.10  operating assistance for public transit systems, for which the 
  2.11  use of money from the multimodal transportation fund has been 
  2.12  recommended to the commissioner by the area transportation 
  2.13  partnership for the geographic area in which the project is 
  2.14  located. 
  2.15     (c) For purposes of this section, "area transportation 
  2.16  partnership" means (1) in the counties of Anoka, Carver, 
  2.17  Chisago, Dakota, Hennepin, Ramsey, Scott, and Washington, the 
  2.18  metropolitan council's transportation advisory board, and (2) in 
  2.19  the remainder of the state, the area transportation partnership 
  2.20  established and appointed by the commissioner. 
  2.21     Sec. 2.  Minnesota Statutes 2000, section 297B.09, 
  2.22  subdivision 1, is amended to read: 
  2.23     Subdivision 1.  [GENERAL FUND SHARE PROCEEDS DEPOSITED.] 
  2.24  Money collected and received under this chapter must be 
  2.25  deposited as provided in this subdivision.  
  2.26     Thirty-two percent of the money collected and received must 
  2.27  be deposited in the highway user tax distribution fund, and the 
  2.28  remaining 68 percent of the money must be deposited in the 
  2.29  general multimodal transportation fund.  
  2.30     Sec. 3.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  2.31     An amendment is proposed to the Minnesota Constitution, 
  2.32  article XIV.  If the amendment is adopted, article XIV will be 
  2.33  amended by adding a section to read: 
  2.34     Sec. 12.  The net proceeds from any tax on the sale of new 
  2.35  and used motor vehicles must be deposited in a multimodal 
  2.36  transportation fund for highway and public transit purposes. 
  3.1      Sec. 4.  [SUBMISSION TO VOTERS.] 
  3.2      The constitutional amendment proposed in section 3 must be 
  3.3   submitted to the people at the 2002 general election.  The 
  3.4   question submitted must be: 
  3.5      "Shall the Minnesota Constitution be amended to require 
  3.6   that all revenue from the motor vehicle sales tax be deposited 
  3.7   in a multimodal transportation fund for highway and public 
  3.8   transit purposes? 
  3.9                                      Yes .......
  3.10                                     No ........"
  3.11     Sec. 5.  [EFFECTIVE DATE.] 
  3.12     Sections 1 to 3 are effective July 1, 2003, except that if 
  3.13  the constitutional amendment proposed in section 4 is not 
  3.14  adopted at the 2002 general election, sections 1 to 3 shall not 
  3.15  take effect.
