A bill for an act
relating to data practices; classifying data obtained in the course of providing
homeownership education, counseling, and training services; proposing coding
for new law in Minnesota Statutes, chapter 13.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) "Grant recipient" includes a local government unit or nonprofit organization
that receives grants from a state agency to provide full cycle homeownership services,
including homeownership education, counseling, and training.

new text begin (b) Data on individuals maintained by a grant recipient from which the identity of
any individual receiving full cycle homeownership services may be determined are private
data on individuals and the grant recipient shall maintain the data in accordance with this
chapter. The agency and any subcontractors of the agency may not own the private data or
require the grant recipient to disclose the private data to the agency or its subcontractors,
but summary data that does not identify individuals may be required for research purposes.
