  1.1                          A bill for an act 
  1.2             relating to state government; providing that the 
  1.3             Minnesota Partnership for Action Against Tobacco is 
  1.4             not a state agency; requiring a report. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [MINNESOTA PARTNERSHIP FOR ACTION AGAINST 
  1.7   TOBACCO.] 
  1.8      (a) The Minnesota Partnership for Action Against Tobacco 
  1.9   (MPAAT) is not subject to the laws governing a state agency in 
  1.10  this state, except as provided in this section. 
  1.11     (b) MPAAT is subject to the Minnesota Government Data 
  1.12  Practices Act, Minnesota Statutes, chapter 13, and the Minnesota 
  1.13  Open Meeting Law, Minnesota Statutes, section 471.705. 
  1.14     (c) Members of the board of directors and the executive 
  1.15  director of MPAAT are considered public officials for purposes 
  1.16  of the Ethics in Government Act, Minnesota Statutes, chapter 10A.
  1.17     (d) MPAAT is a state agency for the purposes of the 
  1.18  following accounting and budgeting requirements: 
  1.19     (1) financial reports and other requirements under 
  1.20  Minnesota Statutes, section 16A.06; and 
  1.21     (2) the state budget system under Minnesota Statutes, 
  1.22  sections 16A.095, 16A.10, and 16A.11. 
  1.23     (e) MPAAT is subject to audits conducted by the legislative 
  1.24  auditor under Minnesota Statutes, section 3.971. 
  1.25     (f) MPAAT shall adopt and publish in the State Register its 
  2.1   standards for awarding grants and contracts, but is not subject 
  2.2   to Minnesota Statutes, section 14.386, specifically, or chapter 
  2.3   14, in general. 
  2.4      (g) The state is not liable for the obligations of MPAAT. 
  2.5      (h) On January 1 and July 1 of each year, MPAAT shall 
  2.6   provide a report to the commissioner of health describing all 
  2.7   grants, contracts, and other expenditures for the purposes set 
  2.8   forth in MPAAT's articles of incorporation during the previous 
  2.9   six-month reporting period.  This first report must be filed on 
  2.10  July 1, 1999.  The report is not required to describe the 
  2.11  expenditure of funds for administrative purposes, such as hiring 
  2.12  employees or entering into leases or contracts for office space, 
  2.13  furniture, utilities, or other services necessary to carry out 
  2.14  MPAAT's purposes.  MPAAT shall provide any additional 
  2.15  information to the commissioner regarding the report within ten 
  2.16  days following the commissioner's written request.
