A bill for an act
relating to local governments; aids and credits; reducing future aid payments
for reductions in vital public safety personnel; proposing coding for new law
in Minnesota Statutes, chapter 477A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Aid reduction for reductions in public safety complements. new text end

new text begin If a
city's or a county's certified aid under sections 477A.011 to 477A.03 was reduced due to
an unallotment under section 16A.152 or under another provision of law in the previous
calendar year and its complement of licensed peace officers or its budget for firefighter
compensation is reduced, then the city or county shall lose its aid payment under sections
477A.011 to 477A.03 in the current calendar year. This subdivision does not apply to aid
reductions related to changes in aid amounts that occur under the formulas in sections
477A.011 and 477A.0124, but does apply to reductions related to appropriation reductions
under section 477A.03.

city's or a county's credit reimbursement under section 273.1384 was reduced due to an
unallotment under section 16A.152 or under another provision of law in the previous
calendar year and its complement of licensed peace officers or its budget for firefighter
compensation is reduced, then the city or county shall lose its credit reimbursement
under section 273.1384 in the current calendar year. This subdivision does not apply
to credit reductions related to reduced reimbursements that occur under the formula in
section 273.1384.

new text begin Calculating a reduction in licensed peace officers complement or
budget for firefighter compensation.

new text begin (a) Beginning in calendar year 2012, by the
first working day after March 30 of each year, each city and county shall certify to the
commissioner of revenue the following amounts:

new text begin (1) the budgeted full-time equivalent number of licensed peace officers plus the
number of full-time equivalent licensed peace officers provided for in any contract entered
into with another entity for providing police services to the city or county in the previous
calendar year as of January 1 of the previous calendar year;

new text begin (2) the actual full-time equivalent number of licensed peace officers employed
directly or indirectly through a contract with another entity that provided police services to
the city or county during the previous calendar year;

new text begin (3) the budgeted amount for firefighter compensation of the previous calendar year
either directly or through a contract with another entity to provide firefighting services in
the jurisdiction as of January 1 of the previous calendar year; and

new text begin (4) the actual amount spent for firefighter compensation in the previous calendar
year either directly or through a contract with another entity to provide firefighting
services in the jurisdiction.

new text begin (b) A reduction in licensed peace officers in the previous year has occurred if the
number reported in paragraph (a), clause (2), is more than ... percent less than the number
reported in paragraph (a), clause (1).

new text begin (c) A reduction in the budget for firefighter compensation in the previous year has
occurred if the amount reported under paragraph (a), clause (4), is more than ... percent
less than the amount reported under paragraph (a), clause (3).
