  1.1                          A bill for an act 
  1.2             relating to education; increasing transportation 
  1.3             funding for charter school students, nonpublic 
  1.4             students, and students subject to hazardous 
  1.5             conditions; authorizing a levy; appropriating money; 
  1.6             amending Minnesota Statutes 1998, section 123B.92, 
  1.7             subdivision 9, and by adding a subdivision; proposing 
  1.8             coding for new law in Minnesota Statutes, chapter 126C.
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 123B.92, 
  1.11  subdivision 9, is amended to read: 
  1.12     Subd. 9.  [NONPUBLIC PUPIL TRANSPORTATION AID.] (a) A 
  1.13  district's nonpublic pupil transportation aid for the 1996-1997 
  1.14  1999-2000 and later school years for transportation services for 
  1.15  nonpublic school pupils according to sections 123B.88, 123B.84 
  1.16  to 123B.86, and this section, equals the sum of the amounts 
  1.17  computed in paragraphs (b) and (c).  This aid does not limit the 
  1.18  obligation to transport pupils under sections 123B.84 to 123B.87.
  1.19     (b) For regular and excess transportation according to 
  1.20  subdivision 1, paragraph (b), clauses (1) and (2), an amount 
  1.21  equal to the product of: 
  1.22     (1) the district's actual expenditure per nonpublic pupil 
  1.23  transported in the regular and excess transportation categories 
  1.24  during the second preceding school year; times 
  1.25     (2) the number of nonpublic school pupils residing in the 
  1.26  district who receive regular or excess transportation service or 
  1.27  reimbursement for the current school year; times 
  2.1      (3) the ratio of the formula allowance pursuant to section 
  2.2   126C.10, subdivision 2, for the current school year to the 
  2.3   formula allowance pursuant to section 126C.10, subdivision 2, 
  2.4   for the second preceding school year. 
  2.5      (c) For nonpublic nonregular transportation according to 
  2.6   subdivision 1, paragraph (b), clause (5), an amount equal to the 
  2.7   product of: 
  2.8      (1) the district's actual expenditure for nonpublic 
  2.9   nonregular transportation during the second preceding school 
  2.10  year; times 
  2.11     (2) the ratio of the formula allowance pursuant to section 
  2.12  126C.10, subdivision 2, for the current school year to the 
  2.13  formula allowance pursuant to section 126C.10, subdivision 2, 
  2.14  for the second preceding school year. 
  2.15     (d) Notwithstanding the amount of the formula allowance for 
  2.16  fiscal years 1997 and 1998 in section 126C.10, subdivision 2, 
  2.17  the commissioner shall use the amount of the formula allowance 
  2.18  for the current year less $300 in determining the nonpublic 
  2.19  pupil transportation revenue in paragraphs (b) and (c) for 
  2.20  fiscal years 1997 and 1998. 
  2.21     Sec. 2.  Minnesota Statutes 1998, section 123B.92, is 
  2.22  amended by adding a subdivision to read: 
  2.23     Subd. 11.  [CHARTER SCHOOL TRANSPORTATION AID.] (a) A 
  2.24  school district required to transport charter school students is 
  2.25  eligible for charter school transportation aid for 1999-2000 and 
  2.26  later school years equal to the sum of the amounts computed in 
  2.27  paragraphs (b) and (c). 
  2.28     (b) For regular and excess transportation according to 
  2.29  subdivision 1, paragraph (b), clauses (1) and (2), an amount 
  2.30  equal to the product of: 
  2.31     (1) the district's actual expenditure per charter school 
  2.32  pupil transported in the regular and excess transportation 
  2.33  categories during the second preceding school year; times 
  2.34     (2) the number of charter school pupils residing in the 
  2.35  district who receive regular or excess transportation service or 
  2.36  reimbursement for the current school year; times 
  3.1      (3) the ratio of the formula allowance under section 
  3.2   126C.10, subdivision 2, for the current school year to the 
  3.3   formula allowance under section 126C.10, subdivision 2, for the 
  3.4   second preceding school year. 
  3.5      (c) For charter school nonregular transportation according 
  3.6   to subdivision 1, paragraph (b), clause (5), an amount equal to 
  3.7   the product of: 
  3.8      (1) the district's actual expenditure for charter school 
  3.9   nonregular transportation during the second preceding school 
  3.10  year; times 
  3.11     (2) the ratio of the formula allowance under section 
  3.12  126C.10, subdivision 2, for the current school year to the 
  3.13  formula allowance under section 126C.10, subdivision 2, for the 
  3.14  second preceding school year. 
  3.15     Sec. 3.  [126C.415] [PUPIL TRANSPORTATION LEVIES.] 
  3.16     Subdivision 1.  [HAZARDOUS CONDITIONS.] A school district 
  3.17  may levy an amount not to exceed the actual costs in the fiscal 
  3.18  year to which the levy is attributable of pupil transportation 
  3.19  services that are necessary because of extraordinary traffic, 
  3.20  drug, or crime hazards. 
  3.21     Subd. 2.  [BUS PURCHASE.] A school district may levy the 
  3.22  amount necessary for the purchase of new school buses. 
  3.23     Subd. 3.  [LATE ACTIVITIES.] A school district may levy an 
  3.24  amount not to exceed the district's actual costs for the late 
  3.25  transportation home from schools for pupils involved in after 
  3.26  school activities for the school year beginning in the year the 
  3.27  levy is certified.  A district that levies under this 
  3.28  subdivision must provide late transportation from school for 
  3.29  students participating in any academic-related activities 
  3.30  provided by the district if transportation is provided for 
  3.31  students participating in athletic activities. 
  3.32     Sec. 4.  [APPROPRIATIONS.] 
  3.33     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.34  LEARNING.] The sums indicated in this section are appropriated 
  3.35  from the general fund to the commissioner of children, families, 
  3.36  and learning for the fiscal years designated. 
  4.1      Subd. 2.  [NONPUBLIC PUPIL TRANSPORTATION AID.] For 
  4.2   nonpublic pupil transportation aid under section 123B.92, 
  4.3   subdivision 9:

  4.11     Sections 1, 2, and 4 are effective for revenue for fiscal 
  4.12  years 2000 and later.  Section 3 is effective July 1, 1999, for 
  4.13  taxes payable in 2000 and later.
