  1.1                          A bill for an act 
  1.2             relating to health; changing the required travel 
  1.3             distance or time to the nearest mental health provider 
  1.4             for health maintenance organizations; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 62D; 
  1.6             repealing Minnesota Rules, part 4685.1010, subpart 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [62D.124] [GEOGRAPHIC ACCESSIBILITY.] 
  1.9      Subdivision 1.  [PRIMARY CARE; MENTAL HEALTH SERVICES; 
  1.10  GENERAL HOSPITAL SERVICES.] Within the health maintenance 
  1.11  organization's service area, the maximum travel distance or time 
  1.12  shall be the lesser of 30 miles or 30 minutes to the nearest 
  1.13  provider of each of the following services:  primary care 
  1.14  services, mental health services, and general hospital 
  1.15  services.  The health maintenance organization must designate 
  1.16  which method is used.  
  1.17     Subd. 2.  [OTHER HEALTH SERVICES.] Within a health 
  1.18  maintenance organization's service area, the maximum travel 
  1.19  distance or time shall be the lesser of 60 miles or 60 minutes 
  1.20  to the nearest provider of specialty physician services, 
  1.21  ancillary services, specialized hospital services, and all other 
  1.22  health services not listed in subdivision 1.  The health 
  1.23  maintenance organization must designate which method is used. 
  1.24     Subd. 3.  [EXCEPTION.] The commissioner shall grant an 
  1.25  exception to the requirements of this section according to 
  1.26  Minnesota Rules, part 4685.1010, subpart 4, if the health 
  2.1   maintenance organization can demonstrate with specific data that 
  2.2   the requirement of subdivision 1 or 2 is not feasible in a 
  2.3   particular service area or part of a service area. 
  2.4      Subd. 4.  [APPLICATION.] (a) Subdivisions 1 and 2 do not 
  2.5   apply if an enrollee is referred to a referral center for health 
  2.6   care services.  
  2.7      (b) Subdivision 1 does not apply: 
  2.8      (1) if an enrollee has chosen a health plan with full 
  2.9   knowledge that the health plan has no participating providers 
  2.10  within 30 miles or 30 minutes of the enrollee's place of 
  2.11  residence; or 
  2.12     (2) to service areas approved before May 24, 1993. 
  2.13     Sec. 2.  [REPEALER.] 
  2.14     Minnesota Rules, part 4685.1010, subpart 3, is repealed.
