  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing private sale of 
  1.3             certain surplus state land bordering public water; 
  1.4             appropriating money. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PRIVATE SALE OF SURPLUS LAND BORDERING PUBLIC 
  1.7   WATERS; SCOTT COUNTY.] 
  1.8      (a) Notwithstanding Minnesota Statutes, sections 92.45; 
  1.9   94.09; 94.10; 97A.135, subdivision 2a; and 103F.535, the 
  1.10  commissioner of natural resources shall sell by private sale the 
  1.11  surplus land bordering public waters that is described in 
  1.12  paragraph (e). 
  1.13     (b) The conveyance shall be in a form approved by the 
  1.14  attorney general for consideration of no less than the appraised 
  1.15  value of the land. 
  1.16     (c) The deed must contain a restrictive covenant that 
  1.17  prohibits altering, disturbing vegetation in, draining, filling, 
  1.18  or placing any material or structure of any kind on or in the 
  1.19  existing wetland area located on the land; prohibits any run-off 
  1.20  from other lands or buildings into said wetland; and prohibits 
  1.21  diverting or appropriating water from said wetland. 
  1.22     (d) The consideration received for the conveyance shall be 
  1.23  deposited in the state treasury and credited to the wildlife 
  1.24  acquisition account in the game and fish fund.  The money is 
  1.25  appropriated to the commissioner of natural resources for 
  2.1   wildlife land acquisition purposes. 
  2.2      (e) The land that may be sold is in the Prior Lake wildlife 
  2.3   management area in Scott county and is described as: 
  2.4      The East 1200 feet of the South 800 feet of the Southwest 
  2.5      Quarter of the Southeast Quarter of Section 22, Township 
  2.6      115 North, Range 22 West.  Including the abandoned 
  2.7      right-of-way of the Chicago, Milwaukee, St. Paul and 
  2.8      Pacific Railroad Company (formerly the Hastings and Dakota 
  2.9      Railway Company).  Containing 22 acres, more or less. 
  2.10     (f) This land no longer fits into the state wildlife 
  2.11  management area system because of hunting limitations, its small 
  2.12  size, and future development planned for the area.  Proceeds 
  2.13  from the sale will be used to purchase lands more suitable for 
  2.14  wildlife management and public use.
