A bill for an act
relating to health occupations; requiring health care providers to obtain a direct
secure messaging address; proposing coding for new law in Minnesota Statutes,
chapters 62J; 214.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Each health care provider must have a direct secure messaging address provided by
a health information service provider in order to securely exchange protected health
information via the Internet. The direct secure messaging transport mechanism must meet
national encryption standards for securely exchanging health care data via the Internet.

new text begin (b) Each provider's direct secure messaging address must be included for each provider
as part of the provider demographic information compiled by a health plan company, state
agency, or health care system, and made available to the public as part of a provider directory.

new text begin (c) For purposes of this section, "health care provider" includes hospitals.

Sec. 2.

new text begin (a) Each health-related licensing board shall require a licensee, as part of the licensee's
licensure renewal requirements, to submit to the board evidence of compliance with section
62J.4983.

new text begin (b) Each health-related licensing board shall collect each licensee's direct secure
messaging address under section 62J.4983, and include the address as part of the licensee's
demographic profile compiled by the board and made available to the public.
