  1.1                          A bill for an act
  1.2             relating to health; establishing eligibility for 
  1.3             medical assistance for certain persons needing 
  1.4             treatment for breast or cervical cancer; appropriating 
  1.5             money; amending Minnesota Statutes 2000, section 
  1.6             256B.055, by adding a subdivision; proposing coding 
  1.7             for new law in Minnesota Statutes, chapter 256B. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 256B.055, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 13.  [CERTAIN PERSONS NEEDING TREATMENT FOR BREAST OR 
  1.12  CERVICAL CANCER.] (a) Medical assistance may be paid for a 
  1.13  person who: 
  1.14     (1) has been screened for breast or cervical cancer under 
  1.15  the centers for disease control and prevention's national breast 
  1.16  and cervical cancer early detection program established under 
  1.17  United States Code, title 42, sections 300k et seq.; 
  1.18     (2) according to the person's treating health professional, 
  1.19  needs treatment, including diagnostic services necessary to 
  1.20  determine the extent and proper course of treatment, for breast 
  1.21  or cervical cancer, including precancerous conditions and early 
  1.22  stage cancer; 
  1.23     (3) is under age 65; 
  1.24     (4) is not otherwise eligible for medical assistance; and 
  1.25     (5) is not otherwise covered under creditable coverage, as 
  1.26  defined under United States Code, title 42, section 300gg(c). 
  2.1      (b) Medical assistance provided for an eligible person 
  2.2   under this subdivision shall be limited to services provided 
  2.3   during the period that the person receives treatment for breast 
  2.4   or cervical cancer. 
  2.5      (c) A person meeting the criteria in paragraph (a) is 
  2.6   eligible for medical assistance without meeting the eligibility 
  2.7   criteria relating to income and assets. 
  2.8      Sec. 2.  [256B.0637] [PRESUMPTIVE ELIGIBILITY FOR CERTAIN 
  2.9   PERSONS NEEDING TREATMENT FOR BREAST OR CERVICAL CANCER.] 
  2.10     Medical assistance is available during a presumptive 
  2.11  eligibility period for persons who meet the criteria in section 
  2.12  256B.055, subdivision 13.  For purposes of this section, the 
  2.13  presumptive eligibility period begins on the date on which a 
  2.14  county human services agency, or an entity designated by the 
  2.15  county, determines based on preliminary information that the 
  2.16  person meets the criteria in section 256B.055, subdivision 13.  
  2.17  The presumptive eligibility period ends on the day on which a 
  2.18  determination is made as to the person's eligibility, except 
  2.19  that if an application is not filed by the last day of the month 
  2.20  following the month during which the determination based on 
  2.21  preliminary information is made, the presumptive eligibility 
  2.22  period ends on that last day of the month. 
  2.23     Sec. 3.  [APPROPRIATION.] 
  2.24     $....... is appropriated from the general fund to the 
  2.25  commissioner of human services for the 2002 fiscal year for 
  2.26  administrative costs associated with implementing Minnesota 
  2.27  Statutes, section 256B.055, subdivision 13.
