1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2008, section 43A.1815, is amended to read:
1.643A.1815VACATION DONATION TO SICK LEAVE ACCOUNT.
1.7 (a) In addition to donations under section43A.181 , a state employee may donate a
1.8total of up to12 40 hours of accrued vacation or sick leave each fiscal year to the sick
1.9leave account of one or more state employees. A state employee may not be paid for more
1.10than 80 hours in a payroll period during which the employee uses sick leave credited to
1.11the employee's account as a result of a transfer from another state employee's vacation
1.12or sick leave account.
1.13 (b) The recipient employee must receive donations, as available, for an illness
1.14or condition of the employee or a member of the employee's family that prevents the
1.15employee from working. The donations must be available without a waiting period as
1.16soon as the employee's sick and vacation leave is exhausted. Donations may be used for
1.17up to a total of 1,044 hours during the duration of eligible employment. Recipients must
1.18continue to accrue vacation and sick leave while they are on donation leave.
1.19(c) An applicant for benefits under this section who receives an unfavorable
1.20determination may select a designee to consult with the commissioner or commissioner's
1.21designee on the reasons for the determination.
1.22 (d) The commissioner shall establish procedures under section43A.04, subdivision
1.234 , for eligibility, duration of need based on individual cases, monitoring and evaluation of
1.24individual eligibility status, and other topics related to administration of this program.
