  1.1                          A bill for an act 
  1.2             relating to education finance; increasing funding for 
  1.3             school lunches and breakfasts; expanding school 
  1.4             eligibility for priority for a fast break for learning 
  1.5             grant; appropriating money; amending Minnesota 
  1.6             Statutes 2000, sections 124D.111, subdivision 1; 
  1.7             124D.115, subdivision 3; and 124D.1155, subdivision 2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 124D.111, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [SCHOOL LUNCH AID COMPUTATION.] Each school 
  1.12  year, the state must pay districts participating in the national 
  1.13  school lunch program the amount of eight 14 cents for each full 
  1.14  paid, reduced, and free student lunch served to students in the 
  1.15  district. 
  1.16     Sec. 2.  Minnesota Statutes 2000, section 124D.115, 
  1.17  subdivision 3, is amended to read: 
  1.18     Subd. 3.  [PROGRAM REIMBURSEMENT.] (a) State funds are 
  1.19  provided to reimburse school breakfasts.  Each school year, the 
  1.20  state must reimburse schools in the amount of 5.1 eight cents 
  1.21  for each fully paid breakfast and for each free and reduced 
  1.22  price breakfast not eligible for the "severe need" rate. 
  1.23     (b) In addition to paragraph (a), each school year the 
  1.24  state must reimburse schools 10.5 12 cents for each free and 
  1.25  reduced price breakfast not eligible for the "severe need" rate 
  1.26  if between 33 and 40 percent of the school lunches served during 
  2.1   the second preceding school year were served free or at a 
  2.2   reduced price. 
  2.3      Sec. 3.  Minnesota Statutes 2000, section 124D.1155, 
  2.4   subdivision 2, is amended to read: 
  2.5      Subd. 2.  [ELIGIBILITY.] An applicant for a grant must be a 
  2.6   public or nonpublic elementary school that participates in the 
  2.7   federal school breakfast and lunch programs.  The commissioner 
  2.8   must give first priority to schools where at least 33 30 percent 
  2.9   of the lunches the school served to children during the second 
  2.10  preceding school year were provided free or at a reduced price.  
  2.11  The commissioner must give second priority to all other public 
  2.12  or nonpublic elementary schools. 
  2.13     Sec. 4.  [APPROPRIATIONS.] 
  2.14     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  2.15  LEARNING.] The sums indicated in this section are appropriated 
  2.16  from the general fund to the department of children, families, 
  2.17  and learning for the fiscal years designated.  
  2.18     Subd. 2.  [SCHOOL LUNCH AID.] For school lunch aid 
  2.19  according to Minnesota Statutes, section 124D.111, and Code of 
  2.20  Federal Regulations, title 7, section 210.17, and for school 
  2.21  milk aid according to Minnesota Statutes, section 124D.118:
