A bill for an act
relating to public safety; requiring law enforcement officers to record the country
of citizenship and immigration status of felon arrestees; requiring peace officers
to report suspected immigration violations by felon arrestees; proposing coding
for new law in Minnesota Statutes, chapter 626.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A peace officer must record the country of citizenship and the
immigration status of each person the officer arrests for a felony offense.

A peace officer who has reasonable cause
to believe that a felon arrestee is an undocumented noncitizen must notify, within 24 hours
of arrest, the United States immigration officer in charge of the district in which the person
is detained of the person's arrest. The peace officer must provide the federal immigration
officer with the noncitizen's name, address, location of detention, offenses leading to arrest,
and nationality, if known.

The commissioner of public safety shall establish a protocol for peace
officers to follow when performing the duties required under subdivisions 1 and 2.
