  1.1                          A bill for an act 
  1.2             relating to lawful gambling; providing for sports 
  1.3             board games; amending Minnesota Statutes 2002, 
  1.4             sections 297E.06, subdivision 2; 349.12, subdivisions 
  1.5             18, 21, 24, by adding a subdivision; 349.151, by 
  1.6             adding a subdivision; 349.211, by adding a 
  1.7             subdivision; 349.2127, subdivision 8. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 297E.06, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [BUSINESS RECORDS.] An organization shall 
  1.12  maintain records supporting the gambling activity reported to 
  1.13  the commissioner.  Records include, but are not limited to, the 
  1.14  following items:  
  1.15     (1) all winning and unsold tickets, cards, or stubs for 
  1.16  pull-tab, tipboard, paddlewheel, sports board, and raffle games; 
  1.17     (2) all reports and statements, including checker's 
  1.18  records, for each bingo occasion; 
  1.19     (3) all cash journals and ledgers, deposit slips, register 
  1.20  tapes, and bank statements supporting gambling activity 
  1.21  receipts; 
  1.22     (4) all invoices that represent purchases of gambling 
  1.23  product; 
  1.24     (5) all canceled checks, check recorders, journals and 
  1.25  ledgers, vouchers, invoices, bank statements, and other 
  1.26  documents supporting gambling activity expenditures; and 
  2.1      (6) all organizational meeting minutes.  
  2.2      All records required to be kept by this section must be 
  2.3   preserved by the organization for at least 3-1/2 years and may 
  2.4   be inspected by the commissioner of revenue at any reasonable 
  2.5   time without notice or a search warrant.  
  2.6      Sec. 2.  Minnesota Statutes 2002, section 349.12, 
  2.7   subdivision 18, is amended to read: 
  2.8      Subd. 18.  [GAMBLING EQUIPMENT.] "Gambling equipment" 
  2.9   means:  bingo hard cards or paper sheets, devices for selecting 
  2.10  bingo numbers, pull-tabs, jar tickets, paddlewheels, paddlewheel 
  2.11  tables, paddletickets, paddleticket cards, sports boards, 
  2.12  tipboards, tipboard tickets, and pull-tab dispensing devices. 
  2.13     Sec. 3.  Minnesota Statutes 2002, section 349.12, 
  2.14  subdivision 21, is amended to read: 
  2.15     Subd. 21.  [GROSS RECEIPTS.] "Gross receipts" means all 
  2.16  receipts derived from lawful gambling activity including, but 
  2.17  not limited to, the following items: 
  2.18     (1) gross sales of bingo hard cards and paper sheets before 
  2.19  reduction for prizes, expenses, shortages, free plays, or any 
  2.20  other charges or offsets; 
  2.21     (2) the ideal gross of pull-tab and tipboard deals or games 
  2.22  less the value of unsold and defective tickets and before 
  2.23  reduction for prizes, expenses, shortages, free plays, or any 
  2.24  other charges or offsets; 
  2.25     (3) gross sales of raffle tickets and paddletickets before 
  2.26  reduction for prizes, expenses, shortages, free plays, or any 
  2.27  other charges or offsets; 
  2.28     (4) gross sale of sports board chances before deduction for 
  2.29  prizes, expenses, shortages, free plays, or any other charges or 
  2.30  offsets; 
  2.31     (5) admission, commission, cover, or other charges imposed 
  2.32  on participants in lawful gambling activity as a condition for 
  2.33  or cost of participation; and 
  2.34     (5) (6) interest, dividends, annuities, profit from 
  2.35  transactions, or other income derived from the accumulation or 
  2.36  use of gambling proceeds. 
  3.1      Gross receipts does not include proceeds from rental under 
  3.2   section 349.164 or 349.18, subdivision 3. 
  3.3      Sec. 4.  Minnesota Statutes 2002, section 349.12, 
  3.4   subdivision 24, is amended to read: 
  3.5      Subd. 24.  [LAWFUL GAMBLING.] "Lawful gambling" is the 
  3.6   operation, conduct or sale of bingo, raffles, 
  3.7   paddlewheels, sports boards, tipboards, and pull-tabs.  
  3.8      Sec. 5.  Minnesota Statutes 2002, section 349.12, is 
  3.9   amended by adding a subdivision to read: 
  3.10     Subd.  33a.  [SPORTS BOARD.] "Sports board" means a game in 
  3.11  which a participant buys a square, line, or other chance on a 
  3.12  board with the winner determined by the outcome of a 
  3.13  professional sporting event.  
  3.14     Sec. 6.  Minnesota Statutes 2002, section 349.151, is 
  3.15  amended by adding a subdivision to read: 
  3.16     Subd. 4c.  [SPORTS BOARD RULES.] The board is authorized to 
  3.17  adopt rules for the conduct of sports board games.  The rules 
  3.18  must provide for operation procedures, internal control 
  3.19  standards, posted information, records, and reports.  The rules 
  3.20  must provide for the award of prizes, method of payout, wagers, 
  3.21  determination of winners, and the specifications of sports 
  3.22  boards.  Sports boards must not exceed 25 lines or 100 squares.  
  3.23  Cash or merchandise prizes may be awarded in sports betting 
  3.24  board games.  Sports board games must be conducted for a 
  3.25  professional sporting event only. 
  3.26     Sec. 7.  Minnesota Statutes 2002, section 349.211, is 
  3.27  amended by adding a subdivision to read: 
  3.28     Subd. 2d.  [SPORTS BOARDS.] The maximum prize which may be 
  3.29  awarded for a sports board chance is $500.  A sports board 
  3.30  chance may not be sold for more than $10. 
  3.31     Sec. 8.  Minnesota Statutes 2002, section 349.2127, 
  3.32  subdivision 8, is amended to read: 
  3.33     Subd. 8.  [MINIMUM AGE.] (a) A person under the age of 18 
  3.34  years may not buy a pull-tab, tipboard ticket, paddlewheel 
  3.35  ticket, or raffle ticket, or a chance to participate in a sports 
  3.36  board or a bingo game other than a bingo game exempt or excluded 
  4.1   from licensing.  Violation of this paragraph is a misdemeanor. 
  4.2      (b) A licensed organization or employee may not allow a 
  4.3   person under age 18 to participate in lawful gambling in 
  4.4   violation of paragraph (a).  Violation of this paragraph is a 
  4.5   misdemeanor. 
  4.6      (c) In a prosecution under paragraph (b), it is a defense 
  4.7   for the defendant to prove by a preponderance of the evidence 
  4.8   that the defendant reasonably and in good faith relied upon 
  4.9   representations of proof of age authorized in section 340A.503, 
  4.10  subdivision 6, paragraph (a).
