A bill for an act
relating to human services; clarifying use of senior nutrition appropriations and
client contributions; amending Minnesota Statutes 2008, section 256.9752,
subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256.9752, subdivision 2, is amended to
read:


Subd. 2.

Authority.

new text begin (a) new text end The Minnesota Board on Aging shall allocate to area
agencies on aging the federal funds which are received for the senior nutrition programs
of congregate dining and home-delivered meals in a manner consistent with federal
requirements.new text begin Federal Title 3 funds received for senior nutrition programs under the Older
Americans Act of 1965, as amended, must be applied towards direct senior nutrition
services and to reimbursement rates for senior nutrition services.

new text begin (b) The board shall use state appropriations for senior nutrition services and client
contributions collected under this section to increase reimbursement rates for congregate
dining and home delivery and shall not use these appropriations or contributions to
supplant federal Title 3 funds received under the Older Americans Act of 1965, as
amended.
