  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying state park 
  1.3             fees; requiring state park campsites to remain open in 
  1.4             peak months; permitting incremental fee increases; 
  1.5             requiring a report; amending Minnesota Statutes 2002, 
  1.6             section 85.055, subdivision 1; proposing coding for 
  1.7             new law in Minnesota Statutes, chapter 85. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 85.055, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [FEES.] The fee for state park permits for: 
  1.12     (1) an annual use of state parks is $20 $...; 
  1.13     (2) a second vehicle state park permit is $15 $...; 
  1.14     (3) a state park permit valid for one day is $4 $...; 
  1.15     (4) a daily vehicle state park permit for groups 
  1.16  is $2 $...; 
  1.17     (5) an employee's state park permit is without charge; and 
  1.18     (6) a state park permit for handicapped persons under 
  1.19  section 85.053, subdivision 7, clauses (1) and (2), is $12 $.... 
  1.20     The fees specified in this subdivision include any sales 
  1.21  tax required by state law. 
  1.22     [EFFECTIVE DATE.] This section is effective May 15, 2007. 
  1.23     Sec. 2.  [85.056] [CAMPING FACILITIES TO REMAIN OPEN.] 
  1.24     Unless authorized by law, a state park may not close its 
  1.25  camping facilities during the peak months in which the park is 
  1.26  generating fee revenue in at least an amount equal to the cost 
  2.1   of operating the camping facilities. 
  2.2      Sec. 3.  [INCREMENTAL FEE INCREASE.] 
  2.3      Notwithstanding Minnesota Statutes, section 16A.1283, 
  2.4   between the effective date of this act and May 15, 2007, the 
  2.5   commissioner of natural resources may incrementally increase 
  2.6   fees by $1 or more under Minnesota Statutes, section 85.055, 
  2.7   subdivision 1, to implement the fee increases required under 
  2.8   section 1.  Fee increases under this section are not rules under 
  2.9   Minnesota Statutes, chapter 14, and Minnesota Statutes, sections 
  2.10  14.385 and 14.386, do not apply.  The commissioner shall publish 
  2.11  notice of each fee increase in the State Register and on the 
  2.12  department Web site. 
  2.13     Sec. 4.  [REPORT REQUIRED.] 
  2.14     By January 15, 2004, the commissioner of natural resources 
  2.15  shall report to the legislature with recommendations for 
  2.16  legislative and departmental changes necessary to make state 
  2.17  park and camping facility operations funded by user fees.
