  1.1                          A bill for an act
  1.2             relating to human services; authorizing a transfer of 
  1.3             federal funds from the TANF reserve account; amending 
  1.4             Minnesota Statutes 1998, section 256J.03, by adding 
  1.5             subdivisions. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 256J.03, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4.  [TRANSFERS TO SOCIAL SERVICES BLOCK GRANT.] (a) 
  1.10  On July 1, 1999, the commissioner shall transfer an amount equal 
  1.11  to ten percent of the state's annual allotment of federal 
  1.12  temporary assistance to needy families block grant money from 
  1.13  the TANF reserve account and add it to the state's allocation of 
  1.14  federal Title XX block grant funds under section 256E.07. 
  1.15     (b) On July 1, 2000, the commissioner shall transfer an 
  1.16  amount equal to 5.68 percent of the state's annual allotment of 
  1.17  federal temporary assistance to needy families block grant money 
  1.18  from the TANF reserve account and add it to the state's 
  1.19  allocation of federal Title XX block grant funds under section 
  1.20  256E.07. 
  1.21     (c) Beginning July 1, 2001, the commissioner shall annually 
  1.22  transfer an amount equal to 4.25 percent of the state's annual 
  1.23  allotment of federal temporary assistance to needy families 
  1.24  block grant money from the TANF reserve account and add it to 
  1.25  the state's allocation of federal Title XX block grant funds 
  2.1   under section 256E.07. 
  2.2      (d) If on July 1 of any fiscal year the balance of federal 
  2.3   funds in the TANF reserve account is insufficient to permit the 
  2.4   transfers specified in paragraphs (a) to (c), the commissioner 
  2.5   shall instead transfer the full balance of federal TANF money in 
  2.6   the reserve account and add it to the state's allocation of 
  2.7   federal Title XX block grant funds under section 256E.07. 
  2.8      (e) Amounts transferred under this subdivision must be used 
  2.9   according to the requirements of United States Code, title 42, 
  2.10  section 604(d)(3)(B). 
  2.11     Sec. 2.  Minnesota Statutes 1998, section 256J.03, is 
  2.12  amended by adding a subdivision to read: 
  2.13     Subd. 5.  [TRANSFERS TO CHILD CARE FUND FOR BASIC SLIDING 
  2.14  FEE.] (a) On July 1, 1999, the commissioner shall transfer an 
  2.15  amount necessary to replace all general fund appropriations 
  2.16  under paragraph (e), but not exceed 20 percent of the state's 
  2.17  annual allotment of federal temporary assistance to needy 
  2.18  families block grant money from the TANF reserve account to the 
  2.19  child care fund under section 119B.04. 
  2.20     (b) On July 1, 2000, the commissioner shall transfer an 
  2.21  amount necessary to replace all general fund appropriations 
  2.22  under paragraph (e), but not exceed 24.32 percent of the state's 
  2.23  annual allotment of federal temporary assistance to needy 
  2.24  families block grant money from the TANF reserve account to the 
  2.25  child care fund under section 119B.04. 
  2.26     (c) Beginning July 1, 2001, the commissioner shall annually 
  2.27  transfer an amount necessary to replace all general fund 
  2.28  appropriations under paragraph (e), but not exceed 25.75 percent 
  2.29  of the state's annual allotment of federal temporary assistance 
  2.30  to needy families block grant money from the TANF reserve 
  2.31  account to the child care fund under section 119B.04. 
  2.32     (d) If on July 1 of any fiscal year the balance of federal 
  2.33  funds in the TANF reserve account is insufficient to permit the 
  2.34  transfers specified in paragraphs (a) to (c), the commissioner 
  2.35  shall first transfer funds as provided under subdivision 4.  The 
  2.36  commissioner shall then transfer the remaining balance of 
  3.1   federal TANF money in the reserve account to the child care fund 
  3.2   under section 119B.04, up to the amount necessary to replace all 
  3.3   general fund appropriations under paragraph (e). 
  3.4      (e) Amounts transferred under this subdivision must be used 
  3.5   to replace state general fund appropriations on a dollar for 
  3.6   dollar basis to provide assistance under section 119B.03.  State 
  3.7   appropriations that are replaced under this subdivision must be 
  3.8   returned to the general fund. 
  3.9      Sec. 3.  [EFFECTIVE DATE.] 
  3.10     Sections 1 and 2 are effective July 1, 1999.
