  1.1                          A bill for an act 
  1.2             relating to state land; authorizing conveyance of 
  1.3             excess rail bank land; amending Minnesota Statutes 
  1.4             1998, section 222.63, subdivision 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 222.63, 
  1.7   subdivision 4, is amended to read: 
  1.8      Subd. 4.  [DISPOSITION PERMITTED.] (a) The commissioner may 
  1.9   lease any rail line or right-of-way held in the state rail bank 
  1.10  or enter into an agreement with any person for the operation of 
  1.11  any rail line or right-of-way for any of the purposes set forth 
  1.12  in subdivision 2 in accordance with a fee schedule to be 
  1.13  developed by the commissioner. 
  1.14     (b) The commissioner may convey any rail line or 
  1.15  right-of-way, for consideration or for no consideration and upon 
  1.16  other terms as the commissioner may determine to be in the 
  1.17  public interest, to any other state agency or to a governmental 
  1.18  political subdivision of the state having power by law to 
  1.19  utilize it for any of the purposes set forth in subdivision 2.  
  1.20     (c) The commissioner may convey a portion of previously 
  1.21  acquired rail bank right-of-way to a state agency or political 
  1.22  subdivision when the commissioner determines that: 
  1.23     (1) the portion to be conveyed is in excess of that needed 
  1.24  for the purposes stated in subdivision 2; 
  1.25     (2) the conveyance is upon terms and conditions agreed upon 
  2.1   by both the commissioner and the state agency or political 
  2.2   subdivision; 
  2.3      (3) after the sale, the rail bank corridor will continue to 
  2.4   be sufficient to meet the purposes of subdivision 2; and 
  2.5      (4) the conveyance will not result in any right-of-way in 
  2.6   the state rail bank being reduced to a width of less than 50 
  2.7   feet at any point. 
  2.8      Proceeds from a sale must be deposited in the rail bank 
  2.9   maintenance account described in subdivision 8. 
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     Section 1 is effective the day following final enactment.
