  1.1                          A bill for an act 
  1.2             relating to crime; changing criminal penalties for the 
  1.3             sale of tobacco to minors; amending Minnesota Statutes 
  1.4             1998, section 609.685, subdivision 2; repealing 
  1.5             Minnesota Statutes 1998, section 609.685, subdivision 
  1.6             1a. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 609.685, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [MISDEMEANOR.] (a) Whoever furnishes or sells 
  1.11  tobacco or tobacco-related devices to a person under the age of 
  1.12  18 years is guilty of a misdemeanor. 
  1.13     (b) It is an affirmative defense to a charge for sale of 
  1.14  tobacco or tobacco-related devices if the defendant proves by a 
  1.15  preponderance of the evidence that the defendant reasonably and 
  1.16  in good faith relied on proof of age as described in section 
  1.17  340A.503, subdivision 6. 
  1.18     Sec. 2.  [REPEALER.] 
  1.19     Minnesota Statutes 1998, section 609.685, subdivision 1a, 
  1.20  is repealed. 
  1.21     Sec. 3.  [EFFECTIVE DATE.] 
  1.22     Sections 1 and 2 are effective August 1, 1999, and apply to 
  1.23  crimes committed on or after that date.
