  1.1                          A bill for an act 
  1.2             relating to employee relations; improving state 
  1.3             employee access to medical clinics; amending Minnesota 
  1.4             Statutes 1998, section 43A.23, by adding a subdivision.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 43A.23, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 4.  [ACCESS TO MEDICAL CLINICS.] Any health plan, 
  1.9   including self-insured health plans, made available to state 
  1.10  employees under this section shall contract with any medical 
  1.11  clinic that:  
  1.12     (1) is designated an essential community provider under 
  1.13  section 62Q.19; 
  1.14     (2) is certified as a rural health clinic under Code of 
  1.15  Federal Regulations, title 42, part 491, subpart A; 
  1.16     (3) agrees to all nonfinancial terms of the plan's provider 
  1.17  contract, including, but not limited to, quality of care, 
  1.18  credentialing, and reporting; and 
  1.19     (4) requests participation in the health plan's 
  1.20  participating provider network.  
  1.21  The contract terms offered to the clinic:  (i) must not require 
  1.22  the use of withholds or targets based on projected annual 
  1.23  medical costs per member; and (ii) must be at least as favorable 
  1.24  as those that apply to other medical clinics under contract with 
  1.25  the plan that provide the same or similar services to the state 
  2.1   employee group insurance program. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective for employee benefit contracts that 
  2.4   are in effect on or after July 1, 1999.
