A bill for an act
relating to environment; prohibiting glass containers on public beaches and
watercraft; requiring proper disposal of waste carried on waters of the state;
providing penalties; proposing coding for new law in Minnesota Statutes,
chapter 86B.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A person may not carry, possess, or use a glass
container on a public beach or aboard an inner tube, kayak, canoe, or other watercraft on
the waters of the state, except under one of the following conditions:

(1) the watercraft has been issued a valid operating permit to carry passengers for
hire by the commissioner of labor and industry;

(2) the glass container contains a medicinal substance that is part of a first-aid kit or
that is prescribed by a licensed physician; or

(3) a person is removing a glass container previously discarded by others and found
in the waters of the state.

A person who is using an inner tube or
operating a kayak, canoe, or other watercraft and who is transporting food or beverages
must transport all refuse and waste to a place where it can be disposed of safely and
lawfully.

A violation of subdivision 1 or 2 is a misdemeanor and
is punishable by a civil penalty not exceeding $20. Each violation may be treated as
a separate offense.

This section is effective the day following final enactment.
