A bill for an act
relating to transportation; establishing exemptions from motor vehicle inspection
requirements for certain farm vehicles; amending Minnesota Statutes 2022, sections
169.781, subdivision 10; 169.782, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 169.781, subdivision 10, is amended to read:

Subd. 10.

Exemptions.

(a) This section does not apply to a vehicle operated by a motor
carrier of passengers, as defined in section 221.012, subdivision 26, if the vehicle has been
inspected under section 221.0252, subdivision 3, paragraph (a), clause (2), within the previous
12 months.

(b) This section does not apply to a covered farm vehicle, as defined in Code of Federal
Regulations, title 49, section 390.5, that is not carrying hazardous materials of a type or
quantity that requires the vehicle to be placarded in accordance with Code of Federal
Regulations, title 49, section 172.504.

new text begin (c) This section does not apply to a farm work truck that is:

new text begin (1) operated in intrastate commerce;

new text begin (2) used in the transportation of anhydrous ammonia to a farm for on-farm use, or from
a farm; and

new text begin (3) not otherwise used in the transportation of hazardous materials of a type or quantity
that requires the vehicle to be placarded in accordance with Code of Federal Regulations,
title 49, section 172.504.

new text begin (d) For purposes of paragraph (c), "farm work truck" means a farm truck, as defined in
section 168.002, subdivision 8, excluding a trailer or semitrailer, or a full-size pickup truck
that meets the requirements for a farm truck under section 168.002, subdivision 8, paragraph
(a), that is registered under section 168.013, subdivision 1a, 1c, or 1e.

Sec. 2.

Minnesota Statutes 2022, section 169.782, subdivision 4, is amended to read:

Subd. 4.

Exceptions.

(a) This section does not apply to a commercial motor vehicle that
is a farm truck that may be operated by a person not holding a commercial driver's license,
provided that before driving the vehicle, a driver must determine that the vehicle is in safe
operating condition.

(b) This section does not apply to a commercial motor vehicle held for resale by a motor
vehicle dealer licensed under section 168.27.

(c) This section does not apply to a covered farm vehicle as defined in Code of Federal
Regulations, title 49, section 390.5, that is not carrying hazardous materials of a type or
quantity that requires the vehicle to be placarded in accordance with Code of Federal
Regulations, title 49, section 172.504.

10, paragraphs (c) and (d), provided that before driving the vehicle, a driver must determine
that the vehicle is in safe operating condition.
