A bill for an act
 relating to transportation; highways; prohibiting a MnPASS facility on a segment
of Interstate Highway 35E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PROHIBITION ON MNPASS FACILITY.

new text begin Notwithstanding Minnesota Statutes, section 160.93, the commissioner of
transportation may not establish along any segment of marked Interstate Highway 35E
between the interchange with marked Interstate Highway 94 and the interchange with
marked Interstate Highway 694:

new text begin (1) a toll facility, as defined in Minnesota Statutes, section 160.84, subdivision 9; or

new text begin (2) a high-occupancy vehicle lane or dynamic shoulder lane, as defined in Minnesota
Statutes, section 160.02, subdivision 18a, which imposes user fees.
