  1.1                          A bill for an act 
  1.2             relating to transportation; proposing an amendment to 
  1.3             the Minnesota Constitution, article XIV, section 10, 
  1.4             and by adding a section; providing that revenue from 
  1.5             future increases in motor fuel taxes be credited 
  1.6             one-half to the highway user tax distribution fund and 
  1.7             one-half to a new Minnesota public transit fund.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.10     The following amendment to the Minnesota Constitution, 
  1.11  article XIV, is proposed to the people. If the amendment is 
  1.12  adopted: 
  1.13     (a) article XIV, section 10, will read: 
  1.14     Sec. 10.  The legislature may levy an excise tax on any 
  1.15  means or substance used for propelling vehicles on the public 
  1.16  highways of this state or on the business of selling it.  The 
  1.17  proceeds of the tax attributable to rates of taxation in effect 
  1.18  on July 1, 2001, shall be paid into the highway user tax 
  1.19  distribution fund.  All other proceeds of the tax shall be paid 
  1.20  one-half into the highway user tax distribution fund and 
  1.21  one-half into the Minnesota public transit fund. 
  1.22     (b) A section will be added to article 14, to read: 
  1.23     Sec. 12.  A Minnesota public transit fund is created to be 
  1.24  used solely for capital and operating expenses of public transit 
  1.25  as defined by law.  The fund consists of proceeds from motor 
  1.26  fuel taxes credited under section 10 and other money credited to 
  2.1   the fund by law. 
  2.2      Sec. 2.  [SUBMISSION TO VOTERS.] 
  2.3      The constitutional amendment proposed in section 1 must be 
  2.4   submitted to the people at the November 2002 general election. 
  2.5   The question submitted must be: 
  2.6      "Shall the Minnesota Constitution be amended to provide 
  2.7   that revenue from any motor fuel tax rate increases enacted by 
  2.8   the legislature after July 1, 2001, be credited one-half to the 
  2.9   highway user tax distribution fund solely for highway purposes 
  2.10  and one-half to a new Minnesota public transit fund solely for 
  2.11  public transit? 
  2.12                                     Yes .......
