A bill for an act
relating to gambling; lawful gambling; authorizing the board to adopt rules for
video pull-tab games; amending Minnesota Statutes 2008, sections 349.12, by
adding subdivisions; 349.151, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 349.12, is amended by adding a
subdivision to read:

new text begin "Video pull-tab game" means an electronically
simulated game authorized by the board that is played and displayed on a video pull-tab
machine.

Sec. 2.

Minnesota Statutes 2008, section 349.12, is amended by adding a subdivision
to read:

new text begin Video pull-tab machine. new text end

new text begin "Video pull-tab machine" means a terminal,
system, or device authorized by the board that permits, upon payment of consideration,
the play of video pull-tab games.

Sec. 3.

Minnesota Statutes 2008, section 349.151, is amended by adding a subdivision
to read:

new text begin (a) The board shall by rule authorize, but not require,
the use of video pull-tab machines.

new text begin (b) Rules adopted under this subdivision must:

new text begin (1) limit the number of machines at any single site the organization owns or leases to
five;
new text end

new text begin (2) permit the board to remotely monitor the operation of the video pull-tab
machines and the internal accounting systems;

new text begin (3) require video pull-tab machines to maintain, on nonresettable meters, a printable,
permanent record of all transactions involving the machine; and

new text begin (4) authorize the board to deactivate a video pull-tab machine without notice for
violation of a law or rule and to implement any other controls deemed by the board
necessary to ensure and maintain the integrity of video pull-tab games operated under
this subdivision.

new text begin (c) The board shall examine prototypes of video pull-tab machines. The board may
contract for the examination of video pull-tab machines and may require working models
of video pull-tab machines to be transported to the locations the board designates for
testing, examination, and analysis. The manufacturer shall pay all costs of any testing,
examination, analysis, and transportation of the model.
