  1.1                          A bill for an act 
  1.2             relating to natural resources; requiring a state park 
  1.3             proposal plan for Grey Cloud Island in Washington 
  1.4             county. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [GREY CLOUD ISLAND STATE PARK PLAN.] 
  1.7      Subdivision 1.  [PLAN REQUIRED.] The commissioner of 
  1.8   natural resources shall prepare a plan according to this section 
  1.9   to establish Grey Cloud Island state park.  The plan shall 
  1.10  address all issues of acquisition, development, land use, 
  1.11  infrastructure needs, and finance. 
  1.12     Subd. 2.  [PLANNING COMMITTEE.] The commissioner shall 
  1.13  prepare the plan in cooperation with a local state park planning 
  1.14  committee.  The committee shall have five members, including: 
  1.15     (1) an elected official from the city of Cottage Grove, 
  1.16  appointed by the Cottage Grove city council; 
  1.17     (2) an elected official from Washington county, appointed 
  1.18  by the Washington county board; 
  1.19     (3) the representative from district 57B; 
  1.20     (4) the senator from district 57; and 
  1.21     (5) a representative of the department of natural 
  1.22  resources, appointed by the commissioner; 
  1.23     Subd. 3.  [PROPOSALS.] (a) The plan shall include two 
  1.24  proposals, according to paragraphs (b) and (c). 
  1.25     (b) One proposal shall include all of Grey Cloud Island in 
  2.1   the proposed state park.  The proposal shall require the state 
  2.2   to pay for all necessary infrastructure improvements. 
  2.3      (c) One proposal shall include only part of Grey Cloud 
  2.4   Island in the proposed state park, with the remainder of the 
  2.5   island available for other uses.  The proposal shall require 
  2.6   that the cost of all necessary infrastructure improvements be 
  2.7   shared by the state, local units of government, and any private 
  2.8   developers. 
  2.9      Subd. 4.  [REQUIRED ELEMENTS.] Both proposals under 
  2.10  subdivision 3 must require that: 
  2.11     (1) land for the proposed park may be acquired from willing 
  2.12  sellers only and that the state shall not use condemnation to 
  2.13  acquire park land; and 
  2.14     (2) Minnesota Statutes, section 477A.14 notwithstanding, 
  2.15  the county treasurer shall allocate payments made in lieu of 
  2.16  taxes under Minnesota Statutes, section 477A.11, among the 
  2.17  county, cities, towns, and school districts on the same basis as 
  2.18  if the payments were taxes on the land.  Payments in lieu of 
  2.19  taxes shall be determined at a rate of 1.5 percent of the 
  2.20  appraised value of land acquired for Grey Cloud Island state 
  2.21  park.  The land shall not be included in any determination of 
  2.22  payments under Minnesota Statutes, section 477A.12, paragraph 
  2.23  (a), clause (1).
