  1.1                          A bill for an act 
  1.2             relating to education; creating an exception to the 
  1.3             high school diploma warranty coverage for kindergarten 
  1.4             through grade 12 students who refuse to remain in a 
  1.5             grade at the school's recommendation; amending 
  1.6             Minnesota Statutes 1998, section 135A.081, subdivision 
  1.7             3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 135A.081, 
  1.10  subdivision 3, is amended to read: 
  1.11     Subd. 3.  [HIGH SCHOOL DIPLOMA WARRANTY COVERAGE.] (a) If a 
  1.12  student who graduated from a public high school scores below the 
  1.13  8th grade level on a confirming test, the student's high school 
  1.14  shall pay the tuition for the student for all remedial courses 
  1.15  in the area covered by the confirming test that the student 
  1.16  takes in the first year after the student's graduation from high 
  1.17  school.  The student's high school shall pay one-half of the 
  1.18  tuition for the student for all remedial courses in the area 
  1.19  covered by the confirming test that the student takes in the 
  1.20  second year after the student's graduation from high school.  
  1.21  This subdivision shall apply to students graduating from a 
  1.22  public high school on or after May 1, 1999. 
  1.23     (b) The payment of tuition by the public high school shall 
  1.24  be waived if: 
  1.25     (1) the high school can demonstrate, through the results of 
  1.26  a standardized test, that the student had attained 8th grade 
  2.1   level performance in the area covered by the confirming test 
  2.2   prior to graduation; or 
  2.3      (2) a kindergarten through grade 12 student refuses to 
  2.4   repeat a grade at the recommendation of a public school and 
  2.5   instead enrolls in the subsequent grade. 
  2.6      Sec. 2.  [EFFECTIVE DATE.] 
  2.7      Section 1 is effective the day following final enactment.  
  2.8   If the effective date of section 1 is after May 1, 1999, section 
  2.9   1 shall apply retroactively to May 1, 1999, to accommodate the 
  2.10  waiver under section 1.
