  1.1                          A bill for an act 
  1.2             relating to retirement; St. Cloud police consolidation 
  1.3             account; providing for the inclusion of account 
  1.4             pension and benefit recipients in the 1997 PERA-P&F 
  1.5             benefit increases enacted during the course of the 
  1.6             consolidation process. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [ST. CLOUD POLICE CONSOLIDATION ACCOUNT; 
  1.9   SPECIAL ONE-TIME POSTRETIREMENT ADJUSTMENT.] 
  1.10     (a) Notwithstanding any provision of general or special law 
  1.11  to the contrary, all service pensioners, disability pensioners, 
  1.12  and survivor benefit recipients of the St. Cloud police 
  1.13  consolidation account who had begun the receipt of pensions or 
  1.14  benefits before December 31, 1997, the effective date of the St. 
  1.15  Cloud police consolidation process under Minnesota Statutes, 
  1.16  chapter 353A, that began in April 1997, are entitled to receive 
  1.17  the pension or benefit increase granted under Laws 1997, chapter 
  1.18  233, article 1, section 72. 
  1.19     (b) The special one-time postretirement adjustment under 
  1.20  paragraph (a) is effective retroactive to January 1, 1998.  The 
  1.21  first payment of pensions and benefits next following the 
  1.22  effective date of this section must include any back payments of 
  1.23  the retroactive postretirement adjustment. 
  1.24     (c) Nothing in this section authorizes the payment of a 
  1.25  special postretirement adjustment to an estate. 
  1.26     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective on the day following its approval by 
  2.2   the city council of the city of St. Cloud and conformity with 
  2.3   Minnesota Statutes, section 645.021.
