  1.1                          A bill for an act 
  1.2             relating to crimes; requiring the sentencing 
  1.3             guidelines commission to add as an aggravating factor 
  1.4             to the guidelines an offender's use of a position of 
  1.5             trust to help assume another's identity. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [SENTENCING GUIDELINES MODIFICATIONS; 
  1.8   AGGRAVATING FACTORS.] 
  1.9      By August 1, 2003, the sentencing guidelines commission 
  1.10  shall modify Minnesota Sentencing Guidelines, section II.D., by 
  1.11  adding to the list of the aggravating factors that may be used 
  1.12  as a basis for sentencing departure, the offender's use of the 
  1.13  offender's position or status, including but not limited to 
  1.14  positions of trust, fiduciary relationships, or agency or 
  1.15  employment relationships, to access private personal information 
  1.16  which is then used by the offender or another to assume 
  1.17  another's identity.
