  1.1                          A bill for an act 
  1.2             relating to cosmetology; exempting services provided 
  1.3             at assisted living establishments from certain 
  1.4             requirements; amending Minnesota Statutes 2000, 
  1.5             section 155A.08, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 155A.08, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [REQUIREMENTS.] (a) The conditions and process by 
  1.10  which a salon is licensed shall be established by the 
  1.11  commissioner by rule.  In addition to those requirements, no 
  1.12  license shall be issued unless the commissioner first determines 
  1.13  that paragraphs (a) to (e) the following requirements have been 
  1.14  satisfied:  
  1.15     (a) (1) compliance with all local and state laws, 
  1.16  particularly relating to matters of sanitation, health, and 
  1.17  safety; 
  1.18     (b) (2) except as provided in paragraph (b), the employment 
  1.19  of a manager, as defined in section 155A.03, subdivision 6; 
  1.20     (c) (3) inspection and licensing prior to the commencing of 
  1.21  business; 
  1.22     (d) (4) if applicable, evidence of compliance with section 
  1.23  176.182; and 
  1.24     (e) (5) evidence of continued professional liability 
  1.25  insurance coverage of at least $25,000 for each claim and 
  2.1   $50,000 total coverage for each policy year for each operator.  
  2.2      (b) A salon located in a housing with services 
  2.3   establishment regulated under chapter 144D or in housing for 
  2.4   individuals age 55 and over for which rents are adjusted to 
  2.5   reflect the household income of the renter is not required to 
  2.6   employ a manager as required by paragraph (a), clause (2).  A 
  2.7   salon located in a housing with services establishment must 
  2.8   comply with all other applicable requirements. 
  2.9      (c) A licensed esthetician or manicurist who complies with 
  2.10  the health, safety, sanitation, inspection, and insurance rules 
  2.11  promulgated by the commissioner to operate a salon solely for 
  2.12  the performance of those personal services defined in section 
  2.13  155A.03, subdivision 4, in the case of an esthetician, or 
  2.14  subdivision 5, in the case of a manicurist.
