  1.1                          A bill for an act 
  1.2             relating to education; allowing a grant applicant to 
  1.3             appeal the commissioner's finding that the applicant 
  1.4             has failed to meet grant criteria; amending Minnesota 
  1.5             Statutes 1998, section 127A.05, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 127A.05, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 6.  [GRANT APPLICANTS' APPEAL TO ADMINISTRATIVE LAW 
  1.11  JUDGE.] An applicant for a grant that is administered by the 
  1.12  commissioner may appeal to an administrative law judge in the 
  1.13  office of administrative hearings the commissioner's finding 
  1.14  that the applicant has failed to meet grant criteria.  The 
  1.15  administrative law judge may conduct a hearing, take oral 
  1.16  testimony, or accept written documentation in reviewing the 
  1.17  commissioner's finding.  If the administrative law judge 
  1.18  determines that the applicant meets the grant criteria, the 
  1.19  commissioner shall award the grant to the applicant.  The 
  1.20  commissioner shall pay the costs of the administrative law judge 
  1.21  to review the commissioner's finding. 
  1.22     Sec. 2.  [EFFECTIVE DATE.] 
  1.23     Section 1 is effective for the 1999-2000 school year and 
  1.24  later and applies to grant programs established after June 30, 
  1.25  1999.
