  1.1                          A bill for an act 
  1.2             relating to transportation; modifying previous 
  1.3             appropriations; requiring grants to local governments 
  1.4             for transportation purposes; amending Laws 2000, 
  1.5             chapter 479, article 1, section 2, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 2000, chapter 479, article 1, section 2, 
  1.8   subdivision 3, is amended to read: 
  1.9   Subd. 3.  State Road Construction                   359,000,000

  1.13  (a) Of this appropriation: 
  1.14  (1) $177,000,000 is for state trunk 
  1.15  highway improvements within the 
  1.16  seven-county metropolitan area 
  1.17  primarily for the purpose of improving 
  1.18  traffic flow and expanding highway 
  1.19  capacity by eliminating traffic 
  1.20  bottlenecks; 
  1.21  (2) $177,000,000 is for improvements on 
  1.22  state trunk highways outside the 
  1.23  seven-county metropolitan area that the 
  1.24  commissioner designates as at-risk 
  1.25  interregional corridors; and 
  1.26  (3) $5,000,000 is for bus transit ways 
  1.27  or highway-related transit advantages. 
  1.28  (b) Of the appropriations under this 
  1.29  section,: 
  1.30  (1) the commissioner may not spend more 
  1.31  than $50,000,000 for program delivery; 
  1.32  and 
  2.1   (2) five percent of the general fund 
  2.2   appropriation must be used to provide 
  2.3   grants to local governments to assist 
  2.4   in paying the local share of 
  2.5   right-of-way acquisition and 
  2.6   construction costs for a project within 
  2.7   a trunk highway corridor.  The 
  2.8   commissioner shall give top preference 
  2.9   for grants to municipalities that are 
  2.10  participating in projects receiving 
  2.11  federal high priority project funds and 
  2.12  that do not receive municipal state-aid 
  2.13  street or county state-aid highway 
  2.14  funds. 
  2.15  (c) The appropriation under this 
  2.16  section is available through June 30, 
  2.17  2003.  On July 1, 2003, any part of 
  2.18  this appropriation not spent cancels to 
  2.19  the trunk highway fund.  The 
  2.20  commissioner shall report by February 
  2.21  1, 2003, to the chairs of the senate 
  2.22  and house of representatives committees 
  2.23  having jurisdiction over transportation 
  2.24  policy and transportation finance on 
  2.25  any projects that the department of 
  2.26  transportation has scheduled to be 
  2.27  constructed with this appropriation 
  2.28  that the commissioner determines will 
  2.29  be canceled or delayed as a result of 
  2.30  any part of this appropriation 
  2.31  canceling to the trunk highway fund.  
  2.32  For purposes of this paragraph, money 
  2.33  encumbered by the commissioner for a 
  2.34  trunk highway project is considered to 
  2.35  be spent.
