  1.1                          A bill for an act 
  1.2             relating to government data practices; building code 
  1.3             violations; classifying data; amending Minnesota 
  1.4             Statutes 1998, section 504.23; proposing coding for 
  1.5             new law in Minnesota Statutes, chapter 13. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [13.442] [BUILDING CODE VIOLATIONS.] 
  1.8      All code violation records pertaining to a particular 
  1.9   parcel of real property and the buildings, improvements, and 
  1.10  dwelling units located on it that are kept by any state, county, 
  1.11  or city agency charged by the governing body of the appropriate 
  1.12  political subdivision with the responsibility for enforcing a 
  1.13  state, county, or city health, housing, building, fire 
  1.14  prevention, or housing maintenance code are public data. 
  1.15     Sec. 2.  Minnesota Statutes 1998, section 504.23, is 
  1.16  amended to read: 
  1.17     504.23 [CODE VIOLATIONS, DISCLOSURE.] 
  1.18     All code violation records pertaining to a particular 
  1.19  parcel of real property and the buildings, improvements and 
  1.20  dwelling units located thereon kept by any state, county or city 
  1.21  agency charged by the governing body of the appropriate 
  1.22  political subdivision with the responsibility for enforcing a 
  1.23  state, county or city health, housing, building, fire prevention 
  1.24  or housing maintenance code shall be available to all persons 
  1.25  having a reasonable need for the information contained in the 
  2.1   records relating to the premises, at reasonable times and upon 
  2.2   reasonable notice to the custodian of the records, for 
  2.3   inspection, examination, abstracting or copying at the expense 
  2.4   of the person obtaining the information.  The persons to whom 
  2.5   the records shall be available under this section include but 
  2.6   are not limited to the following persons and their 
  2.7   representatives: 
  2.8      (a) any person having any legal or beneficial interest in 
  2.9   the premises, including a tenant; 
  2.10     (b) any person considering in good faith the lease or 
  2.11  purchase of the premises; 
  2.12     (c) any person authorized to request an inspection under 
  2.13  section 566.19; and 
  2.14     (d) a party to any action related to the premises, 
  2.15  including actions maintained pursuant to sections 504.18 and 
  2.16  566.18 to 566.33 are public data under section 13.442.
