1.1 A bill for an act 1.2 relating to natural resources; modifying metal 1.3 traction device restrictions on snowmobiles; amending 1.4 Minnesota Statutes 1998, sections 84.871, subdivision 1.5 2; and 84.8715, subdivisions 1 and 2; repealing Laws 1.6 1998, chapter 401, section 24, subdivision 4. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1998, section 84.871, 1.9 subdivision 2, is amended to read: 1.10 Subd. 2. [METAL TRACTION DEVICES ON SNOWMOBILE TRACKS.] 1.11Except as provided in this subdivision,A person may not operate 1.12 a snowmobile with a track equipped with metal traction devices 1.13 onpublic lands, roads, or trails, or public road or trail1.14rights-of-way. Pursuant to section 84.86, the commissioner may1.15adopt rules that: (1) limit the use of nonmetal traction1.16devices; and (2) permit metal traction devices that meet certain1.17specificationsa paved state trail. Metal traction devices may 1.18 be used on all other public lands, roads, and road or trail 1.19 rights-of-way, and on nonpaved state trails. 1.20 Sec. 2. Minnesota Statutes 1998, section 84.8715, 1.21 subdivision 1, is amended to read: 1.22 Subdivision 1. [STICKER REQUIRED; FEE.] A person may not 1.23 operate a snowmobile with a track equipped with metal traction 1.24 devices unless a metal traction device sticker is affixed to the 1.25 snowmobile. The commissioner shall issue a metal traction 1.26 device sticker upon application and payment of a$50$30 fee. 2.1 The sticker is valid forone yearthree years following June 30 2.2 in the year it is issued. Fees collected under this section 2.3 shall be deposited in the state treasury and credited to the 2.4 snowmobile trails and enforcement account in the natural 2.5 resources fund. Money deposited under this section must be used 2.6 for repair of paved public trails damaged by the use of metal 2.7 traction devices on snowmobile tracks, except that any money not 2.8 necessary for this purpose may be used for the grant-in-aid 2.9 snowmobile trail system. 2.10 Sec. 3. Minnesota Statutes 1998, section 84.8715, 2.11 subdivision 2, is amended to read: 2.12 Subd. 2. [PLACEMENT OF STICKER.] The metal traction device 2.13 sticker must be permanently affixed to the forward half of the 2.14 snowmobiledirectly above or below the headlight of the2.15snowmobileon each side of the hood next to the license. 2.16 Sec. 4. [REPEALER.] 2.17 Laws 1998, chapter 401, section 24, subdivision 4, is 2.18 repealed.
