  1.1                          A bill for an act 
  1.2             relating to capital investment; canceling general fund 
  1.3             appropriations for capital projects to the general 
  1.4             fund; authorizing the issuance of trunk highway bonds; 
  1.5             appropriating money for transportation purposes. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7                              ARTICLE 1 
  1.8                    CAPITAL PROJECT CANCELLATIONS 
  1.9      Section 1.  [CAPITAL PROJECT CANCELLATION REPORT.] 
  1.10     Notwithstanding Minnesota Statutes, section 16A.642, 
  1.11  subdivision 1, the general fund appropriations that are 
  1.12  unencumbered or otherwise not obligated that are reported by the 
  1.13  commissioner of finance in 2003, under section 16A.642, 
  1.14  subdivision 1, are canceled February 1, 2003. 
  1.15     Sec. 2.  [TRANSPORTATION; PORT DEVELOPMENT ASSISTANCE.] 
  1.16     The unencumbered balance of the appropriation in Laws 2001, 
  1.17  First Special Session chapter 8, article 1, section 2, 
  1.18  subdivision 4, to the commissioner of transportation for port 
  1.19  development assistance grants, estimated to be $20,832, is 
  1.20  canceled to the general fund. 
  1.21     Sec. 3.  [MINNESOTA STATE COLLEGES AND UNIVERSITIES; 
  1.22  MOORHEAD.] 
  1.23     The unencumbered balance of the appropriation in Laws 2000, 
  1.24  chapter 492, article 1, section 3, subdivision 11, paragraph 
  1.25  (a), to the board of trustees of the Minnesota state colleges 
  2.1   and universities to demolish structures, eliminate blight, and 
  2.2   construct parking facilities, estimated to be $22,580, is 
  2.3   canceled to the general fund. 
  2.4      Sec. 4.  [CHILDREN, FAMILIES, AND LEARNING; YOUTH 
  2.5   ENRICHMENT GRANTS.] 
  2.6      The unencumbered balance of the appropriation in Laws 2000, 
  2.7   chapter 492, article 1, section 5, subdivision 7, to the 
  2.8   commissioner of children, families, and learning for youth 
  2.9   enrichment grants, estimated to be $994,504, is canceled to the 
  2.10  general fund. 
  2.11     Sec. 5.  [ADMINISTRATION.] 
  2.12     Subdivision 1.  [BCA HEADQUARTERS.] The unencumbered 
  2.13  balance of the appropriation in Laws 2000, chapter 492, article 
  2.14  1, section 12, subdivision 6, to the commissioner of 
  2.15  administration for the bureau of criminal apprehension offices 
  2.16  and laboratories, estimated to be $99,788, is canceled to the 
  2.17  general fund. 
  2.18     Subd. 2.  [PREDESIGN FOR HEALTH AND HUMAN SERVICES 
  2.19  FACILITIES.] The unencumbered balance of the appropriation in 
  2.20  Laws 2000, chapter 492, article 1, section 12, subdivision 9, to 
  2.21  the commissioner of administration for predesign of new 
  2.22  facilities for the departments of health and human services, 
  2.23  estimated to be $381, is canceled to the general fund. 
  2.24     Subd. 3.  [AGENCY RELOCATION.] (a) The unencumbered balance 
  2.25  of the appropriation in Laws 2000, chapter 492, article 1, 
  2.26  section 12, subdivision 11, to the commissioner of 
  2.27  administration for agency relocation, estimated to be $53,900, 
  2.28  is canceled to the general fund. 
  2.29     (b) The unencumbered balance of the appropriation in Laws 
  2.30  2002, chapter 393, section 13, subdivision 4, to the 
  2.31  commissioner of administration for agency relocation, estimated 
  2.32  to be $1,499,608, is canceled to the general fund. 
  2.33     Subd. 4.  [CAPITOL AREA ARCHITECTURAL AND PLANNING 
  2.34  BOARD.] The unencumbered balance of the appropriation in Laws 
  2.35  2002, chapter 393, section 14, to the commissioner of 
  2.36  administration for repair and conservation work in areas of the 
  3.1   capitol building, estimated to be $591,614, is canceled to the 
  3.2   general fund. 
  3.3      Subd. 5.  [MINNEAPOLIS; GUTHRIE THEATER.] The unencumbered 
  3.4   balance of the appropriation in Laws 2000, chapter 492, article 
  3.5   1, section 14, subdivision 3, vetoed on May 15, 2000, and 
  3.6   approved by the legislature overriding the veto on May 17, 2000, 
  3.7   as amended by Laws 2002, chapter 393, section 31, subdivision 8, 
  3.8   to the commissioner of administration for a grant to the 
  3.9   Minneapolis community development agency for land acquisition 
  3.10  for the Guthrie Theater, estimated to be $2,000,000, is canceled 
  3.11  to the general fund. 
  3.12     Sec. 6.  [PUBLIC FACILITIES AUTHORITY; WIF.] 
  3.13     The unencumbered balance of the appropriation in Laws 2000, 
  3.14  chapter 492, article 1, section 22, subdivision 3, as amended by 
  3.15  Laws 2000, chapter 499, section 15, Laws 2001, First Special 
  3.16  Session chapter 12, section 15, and Laws 2002, chapter 393, 
  3.17  section 81, to the public facilities authority for the 
  3.18  wastewater infrastructure fund program, estimated to be 
  3.19  $125,443, is canceled to the general fund. 
  3.20     Sec. 7.  [TRADE AND ECONOMIC DEVELOPMENT; REDEVELOPMENT 
  3.21  GRANTS.] 
  3.22     The unencumbered balance of the appropriation in Laws 2000, 
  3.23  chapter 492, article 1, section 22, subdivision 5, to the 
  3.24  commissioner of trade and economic development for redevelopment 
  3.25  grants under Minnesota Statutes, section 116J.561, estimated to 
  3.26  be $17,824, is canceled to the general fund.  
  3.27     Sec. 8.  [EFFECTIVE DATE.] 
  3.28     This article is effective the day following final enactment.
  3.29                             ARTICLE 2 
  3.30                       TRANSPORTATION BONDING 
  3.31  Section 1.  [TRANSPORTATION APPROPRIATIONS AND REDUCTIONS.] 
  3.32     The dollar amounts in the columns under "APPROPRIATION 
  3.33  CHANGE" are added to or, if shown in parentheses, are subtracted 
  3.34  from the appropriations in Laws 2001, First Special Session 
  3.35  chapter 8, as amended, or other law to the specified agencies.  
  3.36  The appropriations are from the general fund or other named fund 
  4.1   and are available for the fiscal years indicated for each 
  4.2   purpose.  The figure "2003" means that the addition to or 
  4.3   subtraction from the appropriations listed under the figure is 
  4.4   for the fiscal year ending June 30, 2003.

  4.10  Sec. 2.  TRANSPORTATION                             130,000,000 
  4.11  This appropriation is from the trunk 
  4.12  highway bond proceeds account in the 
  4.13  trunk highway fund and is available for 
  4.14  expenditure beginning the day following 
  4.15  final enactment.  It is for the same 
  4.16  purposes as specified in Laws 2000, 
  4.17  chapter 479, article 1, section 2, 
  4.18  subdivision 3.  
  4.19  Of the general fund appropriation in 
  4.20  Laws 2000, chapter 479, article 1, 
  4.21  section 2, subdivision 3, $130,000,000 
  4.22  cancels to the general fund.  This 
  4.23  cancellation is effective the day 
  4.24  following final enactment. 
  4.25  Sec. 3.  BOND SALE EXPENSES                             130,000 
  4.26  To the commissioner of finance for bond 
  4.27  sale expenses under Minnesota Statutes, 
  4.28  section 16A.641, subdivision 8.  This 
  4.29  appropriation is from the trunk highway 
  4.30  bond proceeds account in the trunk 
  4.31  highway fund. 
  4.32  Sec. 4.  BOND SALE AUTHORIZATION 
  4.33  To provide the money appropriated in 
  4.34  this act from the trunk highway bond 
  4.35  proceeds account in the trunk highway 
  4.36  fund, the commissioner of finance shall 
  4.37  sell and issue bonds of the state in an 
  4.38  amount up to $130,130,000 in the 
  4.39  manner, upon the terms, and with the 
  4.40  effect prescribed by Minnesota 
  4.41  Statutes, sections 167.50 to 167.52, 
  4.42  and by the Minnesota Constitution, 
  4.43  article XIV, section 11, at the times 
  4.44  and in the amount requested by the 
  4.45  commissioner of transportation.  The 
  4.46  proceeds of the bonds, except accrued 
  4.47  interest and any premium received on 
  4.48  the sale of the bonds, must be credited 
  4.49  to the trunk highway bond proceeds 
  4.50  account in the trunk highway fund. 
  4.51     Sec. 5.  [EFFECTIVE DATE.] 
  4.52     This article is effective the day following final enactment.
