  1.1                          A bill for an act 
  1.2             relating to highways; creating a traffic-impacted 
  1.3             metropolitan city street account in the county 
  1.4             state-aid highway fund and providing for its 
  1.5             allocation; amending Minnesota Statutes 2000, section 
  1.6             162.06, by adding a subdivision; proposing coding for 
  1.7             new law in Minnesota Statutes, chapter 162. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2000, section 162.06, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 7.  [TRAFFIC-IMPACTED METROPOLITAN CITY STREET 
  1.12  ACCOUNT.] After deducting for administrative costs and for the 
  1.13  disaster account, research account, and state park road account 
  1.14  as provided in this section from the remainder of the total sum 
  1.15  provided for in subdivision 1, the commissioner shall set aside 
  1.16  an amount equal to 0.0385 percent of the remainder and place it 
  1.17  into the traffic-impacted metropolitan city street account 
  1.18  created in section 162.089, for distribution as provided in that 
  1.19  section. 
  1.20     Sec. 2.  [162.089] [TRAFFIC-IMPACTED METROPOLITAN CITY 
  1.21  STREET ACCOUNT.] 
  1.22     Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.23  "traffic-impacted metropolitan city" means a city within the 
  1.24  seven-county metropolitan area as defined in section 473.121, 
  1.25  subdivision 2, that (1) has a population of under 5,000 
  1.26  according to the most recent federal decennial census, and (2) 
  2.1   contains at least one street under the city's jurisdiction that 
  2.2   has an average annual daily traffic of 12,000 or more vehicles. 
  2.3      Subd. 2.  [ACCOUNT CREATED.] A traffic-impacted 
  2.4   metropolitan city street account is created in the county 
  2.5   state-aid highway fund, consisting of amounts allocated to the 
  2.6   account under section 162.06, subdivision 7. 
  2.7      Subd. 3.  [APPORTIONMENT.] Funds in the traffic-impacted 
  2.8   metropolitan city street account must be apportioned to each 
  2.9   county in the seven-county metropolitan area so that each county 
  2.10  receives the percentage that the total miles of city streets in 
  2.11  traffic-impacted metropolitan cities in the county bears to the 
  2.12  total miles of city streets in traffic-impacted metropolitan 
  2.13  cities in the metropolitan area. 
  2.14     Subd. 4.  [DISTRIBUTION TO COUNTIES.] Upon determining the 
  2.15  amount of money to be apportioned to each county under section 
  2.16  162.07, the commissioner shall also determine the amounts in the 
  2.17  traffic-impacted metropolitan city street account to be 
  2.18  apportioned under subdivision 3.  The apportionment must be 
  2.19  included in the statement sent to the commissioner of finance 
  2.20  and the county auditor and county engineer of each county under 
  2.21  section 162.08, subdivision 2.  The amounts apportioned and 
  2.22  allocated to each county from the account must be paid by the 
  2.23  state to the treasurer of each county at the same time that 
  2.24  payments are made under section 162.08, subdivision 2. 
  2.25     Subd. 5.  [DISTRIBUTION TO TRAFFIC-IMPACTED METROPOLITAN 
  2.26  CITIES.] The county treasurer of each county receiving money 
  2.27  from the traffic-impacted metropolitan city street account shall 
  2.28  pay to each traffic-impacted metropolitan city in the county, 
  2.29  within 30 days of receipt of payment from the commissioner, a 
  2.30  percentage of the money it receives that year from the account 
  2.31  equal to the percentage that the traffic-impacted metropolitan 
  2.32  city's streets bears to the total mileage of traffic-impacted 
  2.33  metropolitan city streets in the county. 
  2.34     Subd. 6.  [WHEN DISTRIBUTION NOT MADE.] The commissioner 
  2.35  shall not distribute any funds under this section in any 
  2.36  calendar year if the commissioner determines that the 
  3.1   distribution would reduce the apportionment of money from the 
  3.2   county state-aid fund to any county in that calendar year below 
  3.3   the apportionment that county had received in the previous 
  3.4   calendar year. 
  3.5      Subd. 7.  [EXPENDITURE.] A city receiving money from the 
  3.6   traffic-impacted metropolitan city street account may spend the 
  3.7   money only for the construction, reconstruction, and maintenance 
  3.8   of streets that are under the city's jurisdiction.
