  1.1                          A bill for an act 
  1.2             relating to lawful gambling; exempting certain bingo 
  1.3             games from regulation; amending Minnesota Statutes 
  1.4             1998, section 349.166, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 349.166, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [EXCLUSIONS.] (a) Bingo may be conducted 
  1.9   without a license and without complying with sections 349.168, 
  1.10  subdivisions 1 and 2; 349.17, subdivisions 1, 4, and 5; 349.18, 
  1.11  subdivision 1; and 349.19, if it is conducted:  
  1.12     (1) by an organization in connection with a county fair, 
  1.13  the state fair, or a civic celebration and is not conducted for 
  1.14  more than 12 consecutive days and is limited to no more than 
  1.15  four separate applications for activities applied for and 
  1.16  approved in a calendar year; or 
  1.17     (2) by an organization that conducts four or fewer bingo 
  1.18  occasions in a calendar year.  
  1.19     An organization that holds a license to conduct lawful 
  1.20  gambling under this chapter may not conduct bingo under this 
  1.21  subdivision.  
  1.22     (b) Bingo may be conducted within a nursing home or a 
  1.23  senior citizen housing project or by a senior citizen 
  1.24  organization without compliance with sections 349.11 to 349.15 
  1.25  and 349.153 to 349.213 if the prizes for a single bingo game do 
  2.1   not exceed $10, total prizes awarded at a single bingo occasion 
  2.2   do not exceed $200, no more than two bingo occasions are held by 
  2.3   the organization or at the facility each week, only members of 
  2.4   the organization or residents of the nursing home or housing 
  2.5   project are allowed to play in a bingo game, no compensation is 
  2.6   paid for any persons who conduct the bingo, and a manager is 
  2.7   appointed to supervise the bingo, and the manager registers with 
  2.8   the board.  Bingo conducted under this paragraph is exempt from 
  2.9   sections 349.11 to 349.23, and the board may not require an 
  2.10  organization that conducts bingo under this paragraph, or the 
  2.11  manager who supervises the bingo, to register or file a report 
  2.12  with the board.  The gross receipts from bingo conducted under 
  2.13  the limitations of this subdivision are exempt from taxation 
  2.14  under chapter 297A.  
  2.15     (c) Raffles may be conducted by an organization without a 
  2.16  license and without complying with sections 349.154 to 349.165 
  2.17  and 349.167 to 349.213 if the value of all raffle prizes awarded 
  2.18  by the organization in a calendar year does not exceed $750.  
  2.19     (d) Except as provided in paragraph (b), the organization 
  2.20  must maintain all required records of excluded gambling activity 
  2.21  for 3-1/2 years.
