A bill for an act
relating to public safety; requiring peace-officer-involved deaths to be investigated
by the Bureau of Criminal Apprehension; proposing coding for new law in
Minnesota Statutes, chapter 299C.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) As used in this section the following terms have the
meanings provided.

new text begin (b) "Law enforcement agency" has the meaning given in section 626.84, subdivision 1,
paragraph (f).

new text begin (c) "Peace-officer-involved death" occurs when a peace officer's use of force results in
the death of another while the officer is on duty or off duty but performing activities that
are within the scope of the officer's law enforcement duties.

new text begin (d) "Peace officer" has the meaning given in section 626.84, subdivision 1, paragraph
(c).

new text begin Peace-officer-involved death investigations. new text end

new text begin (a) Except as provided for in
paragraph (c), the superintendent shall investigate each peace-officer-involved death in the
state.

new text begin (b) When the investigation is concluded, the superintendent shall file an investigative
report with the county attorney of the county where the death occurred and the chief law
enforcement officer of the law enforcement agency that employs a peace officer under
investigation in the death.

new text begin (c) When a peace officer employed by the Bureau of Criminal Apprehension is the
subject of a peace-officer-involved death investigation, the investigation shall be conducted
by the sheriff of the county where the death occurred.
