A bill for an act
relating to families; modifying distribution of child support federal tax offset;
amending Minnesota Statutes 2012, section 256.741, subdivision 2a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 256.741, subdivision 2a, is amended to read:


Subd. 2a.

Distribution of child support.

(a) The state shall distribute current child
support and maintenance received by the state to an individual who assigns the right to
that support under subdivision 2, paragraph (a).

(b) When the public authority collects child support arrearages on behalf of an
individual who is receiving public assistance, the public authority shall first apply the
collection to satisfy those arrears that are permanently assigned to the state.

(c) When the public authority collects child support arrearages on behalf of an
individual who is not receiving public assistance, the public authority shall first apply the
collection to satisfy those arrears that are not permanently assigned to the state.

(d) When the public authority collects child support arrearages certified under
the federal tax offset, the public authority shall deleted text begin first applydeleted text end new text begin distributenew text end the collection new text begin in
the following priority: first
new text end to satisfy new text begin current support, then to those arrears that are not
permanently assigned to the state, and then to
new text end those arrears that are permanently assigned
to the state.
