  1.2             relating to capital improvements; authorizing spending 
  1.3             to acquire and better public land and buildings and 
  1.4             other public improvements of a capital nature with 
  1.5             certain conditions; requiring certain studies and 
  1.6             reports; authorizing sale of state bonds; 
  1.7             appropriating money. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9   Section 1.  [CAPITAL IMPROVEMENT APPROPRIATIONS.] 
  1.10     The sums in the column under "APPROPRIATIONS" are 
  1.11  appropriated from the bond proceeds fund, or another named fund, 
  1.12  to the state agencies or officials indicated, to be spent for 
  1.13  public purposes.  Appropriations of bond proceeds must be spent 
  1.14  as authorized by the Minnesota Constitution, article XI, section 
  1.15  5, paragraph (a), to acquire and better public land and 
  1.16  buildings and other public improvements of a capital nature, or 
  1.17  as authorized by article XI, section 5, paragraphs (b) to (j), 
  1.18  or article XIV.  Unless otherwise specified, the appropriations 
  1.19  in this act are available until the project is completed or 
  1.20  abandoned.

  3.11  (c) Teaching and Technology Center                    3,000,000
  3.12  To predesign and design a teaching and 
  3.13  technology center for the Institute of 
  3.14  Technology. 
  3.15  Subd. 3.  Twin Cities - St. Paul                               
  3.16  Veterinary Diagnostic Laboratory                      1,500,000
  3.17  To renovate and upgrade the veterinary 
  3.18  diagnostic laboratory to provide 
  3.19  additional laboratory space for a 
  3.20  veterinary molecular diagnostic 
  3.21  laboratory.  The renovation and upgrade 
  3.22  must include space for molecular 
  3.23  diagnostic testing for paratuberculosis 
  3.24  (Johne's disease), porcine reproductive 
  3.25  and respiratory syndrome virus in 
  3.26  swine, avian pneumovirus in turkeys, 
  3.27  bovine mastitis, and emerging and 
  3.28  foreign animal diseases. 
  3.29  Subd. 4.  Morris                                      8,600,000
  3.30  To design, renovate, furnish, and equip 
  3.31  the social science building to correct 
  3.32  building code deficiencies, remodel the 
  3.33  interior, install new windows, upgrade 
  3.34  the building's mechanical and 
  3.35  electrical systems, replace the roof, 
  3.36  and construct an addition over the 
  3.37  existing auditorium wing to create 
  3.38  space for faculty offices, and to 
  3.39  install fire protection systems in 
  3.40  three student housing facilities. 
  3.41  This appropriation is not available 
  3.42  until the commissioner of finance has 
  3.43  determined that at least $400,000 has 
  3.44  been committed from nonstate sources. 
  3.45  Subd. 5.  Research and Outreach        
  3.46  Centers                                               2,508,000
  3.47  To acquire land and design, construct, 
  3.48  furnish, and equip facilities at 
  3.49  research and outreach centers.  
  3.50  Projects funded by this appropriation 
  3.51  include: 
  3.52  (1) research laboratory and office 
  3.53  space at the Northwest ROC at 
  3.54  Crookston; 
  3.55  (2) an addition to the aspen/larch 
  3.56  genetics laboratory at the North 
  3.57  Central ROC at Grand Rapids and 
  4.1   acquisition of land for the development 
  4.2   of two test planting sites to conduct 
  4.3   research on fast growing trees; 
  4.4   (3) an addition to the administration 
  4.5   building at the Southern ROC at Waseca; 
  4.6   and 
  4.7   (4) of this amount, $70,000 is to 
  4.8   construct an environmentally friendly 
  4.9   swine farrowing demonstration facility 
  4.10  at the West Central ROC, subject to 
  4.11  Minnesota Statutes, section 16A.695. 
  4.12  Subd. 6.  Debt Service
  4.13  (a) The board of regents shall pay the 
  4.14  debt service on one-third of the 
  4.15  principal amount of state bonds sold to 
  4.16  finance projects authorized by this 
  4.17  section, except that, where a nonstate 
  4.18  match is required, the debt service is 
  4.19  due on a principal amount equal to 
  4.20  one-third of the total project cost, 
  4.21  less the match committed before the 
  4.22  bonds are sold.  After each sale of 
  4.23  general obligation bonds, the 
  4.24  commissioner of finance shall notify 
  4.25  the board of regents of the amounts 
  4.26  assessed for each year for the life of 
  4.27  the bonds. 
  4.28  (b) The commissioner shall reduce the 
  4.29  board's assessment each year by 
  4.30  one-third of the net income from 
  4.31  investment of general obligation bond 
  4.32  proceeds in proportion to the amount of 
  4.33  principal and interest otherwise 
  4.34  required to be paid by the board.  The 
  4.35  board shall pay its resulting net 
  4.36  assessment to the commissioner of 
  4.37  finance by December 1 each year.  If 
  4.38  the board fails to make a payment when 
  4.39  due, the commissioner of finance shall 
  4.40  reduce allotments for appropriations 
  4.41  from the general fund otherwise 
  4.42  available to the board and apply the 
  4.43  amount of the reduction to cover the 
  4.44  missed debt service payment.  The 
  4.45  commissioner of finance shall credit 
  4.46  the payments received from the board to 
  4.47  the bond debt service account in the 
  4.48  state bond fund each December 1 before 
  4.49  money is transferred from the general 
  4.50  fund under Minnesota Statutes, section 
  4.51  16A.641, subdivision 10. 
  4.52  Subd. 7.  Contingencies                              
  4.53  The commissioner of finance must 
  4.54  combine into one account, under the 
  4.55  control of the board of regents, the 
  4.56  portion of each appropriation in this 
  4.57  section that is attributable to the 
  4.58  amount budgeted for contingencies for 
  4.59  projects in this section.  The board 
  4.60  must manage the account to pay for 
  4.61  exceptional but necessary costs of 
  4.62  projects authorized in this section.  
  4.63  Upon substantial completion or 
  4.64  abandonment of all projects authorized 
  5.1   in this section, the board must use any 
  5.2   funds remaining in the contingency 
  5.3   account for HEAPR under Minnesota 
  5.4   Statutes, section 135A.046.  The board 
  5.5   of regents must report by February 1 of 
  5.6   each even-numbered year to the chairs 
  5.7   of the house and senate committees with 
  5.8   jurisdiction over capital investments 
  5.9   and higher education finance, and to 
  5.10  the chairs of the house ways and means 
  5.11  committee and the senate finance 
  5.12  committee on how the money in the 
  5.13  contingency account has been allocated 
  5.14  or spent. 
  5.15  Sec. 3.  MINNESOTA STATE COLLEGES AND

  7.33  (a) The board shall pay the debt

  8.46  For a grant in accordance with the 
  8.47  metropolitan magnet school grant 
  8.48  program under Minnesota Statutes,

  8.50  Education Program joint powers board to 
  8.51  acquire land, prepare a site,

  8.53  for the Southwest Integration Magnet

  9.9   that at least an equal amount has been 
  9.10  committed from nonstate sources.  The 
  9.11  proportional share of the in-kind 
  9.12  contributions for the planetarium of 
  9.13  land, parking facilities, skyways, and 
  9.14  municipal infrastructure for the 
  9.15  planetarium may be counted as part of 
  9.16  the match.  The proportional share of 
  9.17  the costs to the city of constructing 
  9.18  mechanical and electrical systems, 
  9.19  common areas, service areas, freight 
  9.20  elevators, and walls and roofs for the 
  9.21  planetarium shared with the Minneapolis 
  9.22  library and included in the costs of 
  9.23  constructing the library may also be 
  9.24  counted as part of the match. 
  9.25  The legislature intends not to 
  9.26  appropriate additional money to 
  9.27  construct the planetarium until at 
  9.28  least $4,000,000 in cash contributions 
  9.29  have been committed to the project from 
  9.30  other than state or local government 
  9.31  funds. 
  9.32  Subd. 5.  Asian Community Center                      1,000,000
  9.33  For a grant to the city of St. Paul to 
  9.34  design, construct, furnish, and equip 
  9.35  an Asian community center, subject to 
  9.36  Minnesota Statutes, section 16A.695. 
  9.37  This appropriation is not available 
  9.38  until the commissioner has determined 
  9.39  that at least an equal amount has been

  9.41  Subd. 6.  Colin Powell Youth

  9.46  Powell Youth Leadership center in

 26.7   bonds of the state in an amount up to $356,480,000 in the 
 26.8   manner, upon the terms, and with the effect prescribed by 
 26.9   Minnesota Statutes, sections 16A.631 to 16A.675, and by the 
 26.10  Minnesota Constitution, article XI, sections 4 to 7.  
 26.11     Sec. 24.  [EFFECTIVE DATE.] 
 26.12     This act is effective the day following final enactment.
