A bill for an act
relating to education finance; requiring the
commissioner of education to conduct a study on the
effect of property tax payments on charter school
finances; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

STUDY.

new text begin Commissioner to conduct study. new text end

new text begin The
commissioner of education, in consultation with the commissioner
of revenue, must conduct a study to evaluate the impact of
property tax payments on charter school finances. The study
must identify the types of building lease arrangements and
building ownership configurations that subject the owner of a
charter school facility to state and local property taxes. The
study must also determine whether assessment practices related
to charter school facilities are consistent across the state.

new text begin The commissioner of education must
report the results of the study to the house and senate
committees with jurisdiction over education and taxes by
February 15, 2006. The commissioner of education may include in
the report proposed legislation to clarify the property tax
treatment of charter school facilities.
