  1.1                          A bill for an act 
  1.2             relating to highways; holding owner and operator of 
  1.3             overweight implement of husbandry liable for damage to 
  1.4             roads and bridges; amending Minnesota Statutes 2002, 
  1.5             section 169.801, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 169.801, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4.  [LIABILITY FOR DAMAGE CAUSED BY OVERWEIGHT 
  1.10  IMPLEMENT OF HUSBANDRY.] The owner and operator of an implement 
  1.11  of husbandry that exceeds the maximum weight limits specified or 
  1.12  allowed under section 169.823, 169.824, 169.826, 169.827, 
  1.13  169.828, 169.829, 169.832, 169.84, 169.86, or 169.87 when 
  1.14  operated on a highway or bridge are liable for all resulting 
  1.15  damage sustained by the highway or bridge due to operation or 
  1.16  movement of the overweight implement in accordance with section 
  1.17  169.88.  This subdivision supersedes any inconsistent or 
  1.18  contrary provision of subdivision 2 or other law.
